THE BAY CITIES OBSERVER

THE WALLS OF SILENCE THAT PROTECT LEO MAGERS

by Virginia McCullough

Over the past several days I have received many emails congratulating me on my "exclusive" articles reporting the suspicious death of Anna Marie Cavazos Magers.   Many of these emails have come from residents in Marin and Sonoma counties.  I would like to take full credit for my "scoop" but I cannot do that.  To be totally fair, I have to give credit where credit is due.  There have been several walls of silence erected to totally insulate Leo Magers from the consequences of his many violent acts.  These walls can be best identified by naming them after the colors most often associated with the agencies involved in the cover up.

The Blue Wall of Silence is the Rohnert Park Police Department.
The Green Wall of Silence is the Sonoma County School District.
The Yellow Wall of Silence is the total lack of media coverage.
The Violet Wall of Silence is the total failure by CPS to protect children.
The Red Wall of Silence is the collusion of corrupt attorneys.
The Black Wall of Silence is the obstruction of justice by the judges of Solano, Marin and Sonoma Counties.

THE BLUE WALL OF SILENCE:

Leo Magers has been a long time resident of Rohnert Park.  He has lived at his home on Fauna Street and has entertained several girlfriends there prior to his marriage to Anna Marie Cavazos Magers on February 14, 1998.  Yesterday Leo Magers submitted proof of his "confidential" marriage license to the Sonoma County Coroner's office.

The Rohnert Park Police Department is well aware of Leo Mager's alcohol and drug abuse.  The "Blue Line" has responded to many calls at the Fauna Street address.  These reports are contained in court records in both  Solano, Sonoma and Marin Counties.

According to the court records in Case No. SCV-194243 filed April 18, 1997, from 1984 to 1988 "Leo Magers lived with Susan McKnight, his fiancee, during which time he beat her, locked her in a bedroom for two weeks and threatened her physically and emotionally.  Leo Magers broke Susan McKnight's nose, and caused her to have a miscarriage.  Ms. McKnight obtained medical treatment, and provided reports to the Rohnert Park Police."  The declaration of Susan McKnight dated 4-15-97 filed in this case details Mager's hitting her, engaging in smoking cocaine (free-basing) and drinking.  She would witness him incoherent, and having black-outs, where he would forget what he was doing.  The McKnight declaration entered as an exhibit in the case states: "I believe that Leo Magers is a danger to himself and others and he did not want any children.  Haleigh Mardeusz is not safe living with Leo Magers, and the Court should look into Mr. Magers' past history of abuse to prevent an innocent child from becoming victimized at the hands of Mr. Magers."

Following a brief affair between Leo Magers and Carol Mardeusz, the child Haleigh was born.  According to court documents Leo Magers denied paternity.  The declaration of Toni Novak, a supervisor of Sonoma County Legal Services Foundation dated  9-11-95 states: (Leo Magers) said "he did not want this child, and had wanted nothing to do with this child and was being penalized by being asked to pay for visitation."  The Sonoma County District Attorney forced Magers to do a blood test to determine paternity according to the declaration of Carol Mardeusz dated 1-27-91.  The results of the blood test identified Leo Magers as the father and Sonoma County ordered him to pay child support that was collected and controlled by the county's child suppot division Sonoma County's District Attorney's office.

During the months of October 1992 through March or April of 1993, Leo Magers states under penalty of perjury that he had an affair involving sex and drug use with a woman named Tina E. Bob.  Testifying in a custody case in Solano County entitled Tina E. Bob vs Jerry L. Bob (Case No. F-024625) Magers responds to questioning by stating that he had seen Tina E. Bob use alcohol and cocaine.  He is asked, "Can you tell the court how you came to see her doing cocaine and using alcohol?"  Magers responds under penalty of perjury, "Well, some --- at some point during the relationship cocaine came up and I had -- I have had friends from my past when I used to use cocaine, and so on two occasions or that came up, she was all for that, so..."  The lawyer asks, "All for what?"  Magers states, "All for doing some cocaine" and he continues "So I arranged and then purchased the cocaine.  On two occasions, and then  and she---".  The attorney asks, "Who used primarily most of the cocaine?"  Magers replies, "Well, as I said in the past, I'm certain I would have used plenty of it but in that point of time, I was through with the drug so I do one line and she'd do the rest; and we're talking about a quantity of a 16th which is, as I recall, is a gram and three quarters or something like that."

Cocaine use produces violent, unpredictable behavior in its users.  Later in the transcript of the Solano County Case Magers says, referring to his girlfriend Tina Bob,  "Later that day she goes to a friend, to a mutual friend's office, to a doctor's office.  She shows up with her arm in a sling and a black eye.  She tells this friend that I broke her arm and hit her in the eye from the night before and in a black-out, and this was ludicrous."  This is the second woman who has accused Leo Magers of violently attacking her during cocaine induced black-outs.

When Haleigh was one year old, two of Leo Magers' neighbors, Robert Law and Richard Gerbec, according to the declarations they submitted on November 27, 1991, saw Magers throw the baby on top of a car while screaming swear words at her.  Because of this violent act that took place on Halloween night in 1991, Carol Mardeusz filed an OSC and Custody/Paternity Action on 11-27-91 (Sonoma County Case No. 194243).  On February 24, 1992, the Sonoma County Superior Court ordered full legal and physical custody of Haleigh to her mother, Carol Mardeusz.  Any visitation by the father, Leo Magers, had to be supervised by a third party.  This order remains the only legally valid custody order.  Subsequently, Magers lost all visitation rights because he did not comply with the court order that he undergo a probation study.  Throughout numerous court hearings that followed in Marin and Sonoma counties there has NEVER been a hearing as required by law to change custody of the child to the father.    Magers' attorney, Catherine Conner, simply obtained a series of Temporary Restraining Orders signed by her employers, the judges of Sonoma County.  Neither Conner nor Magers could allow a full hearing before a court to change custody because a probation report would disclose Magers' alcohol and drug addiction and his long history of violent acts against women.

Over the years that followed the boys in blue at the Rohnert Park Police Department would respond many more times to reports of Leo Magers abusing his daughter who was hand delivered to him by the crooked judges and crooked lawyers, in two counties in the state of California.  The public safety officers cooperated with the Sonoma County school district and the judiciary, assisted by attorney Catherine Conner in her fight to protect Leo Magers.

Last Friday evening the Rohnert Park Police Department responded to find Anna Marie Cavazos Magers dead in her home.  They knew that Haleigh and Baby Lee were at risk and they allowed the children to remain in Magers' care until late Sunday evening.  When Detective Scott Mitchell was contacted by a Santa Rosa Press Democrat reporter Sunday afternoon, a hastily created press release was prepared and faxed to the reporter by Mitchell.  When I requested a copy by faxed to me, I was told it no longer existed.  Perhaps it is because the press release did not name Leo Magers as the husband of the deceased. Click to read. The boys in blue are still protecting Leo Magers.  Why?

The next article in this series will document how the green wall of silence, the Sonoma County School District, cooperated with attorney Catherine Conner and the Rohnert Park Police Department to protect cocaine dealer Leo Magers.
