UPDATE! THE ROHNERT PARK POLICE DEPARTMENT AND LEO MAGERS

The Rohnert Park Police Department responded to the home of Leo Magers last Sunday night following the "suspicious" death of his wife, Ana Marie Cavazos Magers, the previous Friday evening.  Several concerned citizens reported to Sonoma County's Child Protective Services and the Rohnert Park Police Department that two children remained in the care of Leo Magers.  Ana and Leo's 2 1/2 year old son,  Baby Lee, and  11 year old, Haleigh, the child of Leo Magers and Carol Mardeusz.  It was reported that the Fahy brothers, two long time police officers, found Leo Magers drunk when they arrived at the home and they contacted Magers' brother who lives in Contra Costa County and turned the two children over to him.  CPS was advised that the situation had "been handled" by the Rohnert Park Police and CPS did not go to the home to determine the condition of the children.

This reporter phoned all of the local newspapers Sunday evening and gave the editors the story.  The editors said that their reporters contacted the Rohnert Park Police Department the first thing Monday morning.  They were told that the police "were not treating the death as a homicide"  but an accidental death.  Supplied with that information the local newspapers, with the exception of The Pacific Sun, did not cover the story at all even though Carol Mardeusz' concern for her child had resulted in an attempt to recall Marin County District Attorney,  Paula Kamena earlier this year.  At that time Leo Magers' name was all over the newspapers and the internet.  Readers may click on The Virginia McCullough Archives at https://newsmakingnews.com for a complete background on this case and its repercussions.

Monday, December 11, 2001, this reporter contacted the Sonoma County Coroner's office and was told that it would take approximately six weeks before the coroner could determine the cause of death of  Leo Magers' 33 year old wife, Ana.

This information certainly brings into question the comments made to reporters that same day by the Rohnert Park Police Department.  The Fahy brothers and, their brothers in blue, had apparently made a greatly premature decision about Ana's demise. The police had a possible homicide.  At the very least when police responded they found a very young woman dead and the body had bruises and a broken finger.  It must be assumed that the police did nothing to protect the crime scene or protect the children because they left these two material witnesses to Ana's death in charge of Leo Magers from Friday night until Sunday evening.  They then protected Leo Magers once again by contacting his brother and placing the children in his care.  The children are still accessible to Leo Magers as long as they remain in the care of Brad Patrick Magers.

CPS has received countless calls from concerned citizens because of its failure to place the children in the safe care of a neutral third party.  California law requires that CPS intervene in the case of a child of Baby Lee's tender age.   Yesterday I spoke with Carol Bauers, head of CPS for Sonoma County who said that she would contact Sonoma County Counsel to see about issuing a Petition 300 hearing to remove the children in accordance with state law.

On December 12, 2001 I notified Rohnert Park Police Lt. John Thompson, who is in charge of the "investigation" of the death of Ana Marie Cavazos Magers, that my articles would supply a well documented background on Leo Magers and advised him to go to www.newsmakingnews.com to read my articles.  I also offered to supply the documents that support the articles to his office upon his request.  At 5:05 pm the web site's server indicated the Rohnert Park Police Department logged on and pulled down all of the articles dealing with the the Carol Mardeusz/Leo Magers custody battle over Haleigh Magers-Mardeusz.  The police remained on line for approximately one-half hour that evening.

Earlier that afternoon the Rohnert Park Police Department's acting chief, Tom Bullard, had received an interesting letter from Carol Mardeusz' attorney Pat Barry.  I have provided a "click" that will send readers to an edited version of that letter.  Click.  Readers will note that this reporter has edited out the final paragraph on page 2 because it deals with the ongoing misconduct of Leo Magers and how he addresses the issues FOLLOWING the death of his wife.  The information contained in that paragraph should lead to a whole separate group of problems for Magers IF the proper authorities properly investigate the allegations.  The unedited version of the Barry letter was forwarded to the Sonoma County Coroner's office.  That office still maintained control over Ana's body late yesterday afternoon.

Under California Law any one of a number of officials, including the coroner, may call for a coroner's inquest to fully investigate the circumstances of a "suspicious" death.  It will be interesting to see what authority will take the moral high ground and call for a full coroner's inquest into Mrs. Magers' death.  This reporter urges that such a inquest be impaneled immediately.
