It has now been ten days since Ana Marie Cavazos Magers was found dead under suspicious circumstances on Leo Magers' kitchen floor in Rohnert Park, California. Two days later the Rohnert Park Police Department turned Leo Magers' two children over to Magers' brother, Brad Patrick Magers, when they found Leo Magers drunk in his home. Sonoma County Children's Protective Services had been notified by Mardeusz's family members and friends of the circumstances surrounding Anna's mysterious death and of the possible danger to the children as long as they remained in the care of Leo Magers. Leo Magers has a long history of violence, alcohol and drug abuse. The Rohnert Park Police got to the house and told CPS the situation "was handled". Several sources have told this reporter that the children were moved to Brad Patrick Magers' home in Contra Costa County. Brad Magers wife goes by the name Cynthia Starsiak. Eight days have passed and not one law enforcement officer or anyone in CPS has had the common courtesy, in this Christmas season, to check on the well being of 11-year old Haleigh Magers Mardeusz and contact her mother, Carol Mardeusz, with the results of what is commonly called a "well baby check". It is important to note that Carol Mardeusz has the only LEGAL custody order of Haleigh after a full hearing in accordance with California state law. Yet, through a song and dance show orchestrated through smoke and mirrors by Marin and Sonoma counties, this mother has not been allowed to see or speak with her daughter since the late fall of 1995 - six years ago. During that entire time Carol Mardeusz and Haleigh's sister, Natalie, have fought to try to protect the child and regain physical custody.
Any parent would understand the agony of having a child forcibly removed from your home for six years by corrupt courts and crooked lawyers. In this particular case the courts and lawyers were conspiring with district attorneys, public defenders, law enforcement and child protective services to steal a young girl who had been abused while they protected a violent man who had not wanted this child from birth. He simply did not want to pay child support and he did not want his history exposed in the media.
On Friday, December 14, 2001 this reporter and mother, Carol Mardeusz individually contacted the Contra Costa Sheriff's Department by phone at (925) 646-2441 and requested a "well baby check" on Haleigh Mardeusz. I spoke with sheriff's dispatchers #54814 and #55423. After explaining the complicated story twice, the second dispatcher placed a call to the San Ramon Police Department [direct line (925) 973-2700]. The Police Chief of San Ramon is Brian Lindbloom. I followed up with a phone call to the Police Chief and some time later received a return call from a Sgt. Jim Telles who told me that two officers were responding to the home of Mr. and Mrs. Brad Patrick Magers and they would let me know when the "well baby check" had been completed.
Throughout the afternoon hours there were several calls between the San Ramon Police Department and Carol Mardeusz and myself. The early calls indicated that the two officers responding, Officers Schultz and Stangel were concerned and acting in a responsible manner in accordance with police policies.
Carol Mardeusz waited anxiously by her home phone for word from the officers who had talked to her several times previously from their mobile unit. She had asked this reporter to use her cell phone number to keep the home phone free. At approximately 3:30 pm I was on the cell phone with Mardeusz when I heard her home phone ring. Carol asked me to hold and I heard her say, "No, I'm not trying to contact my child. I asked the police to make a "well baby check" and let me know if she is all right." Then her voice became frightened and she said, "How can you revoke my probation just because I want to see if my baby is safe?"
Marin County has Carol Mardeusz on probation status after a jury convicted her of perjury for trying to regain physical custody of her daughter. The prosecutors used altered and redacted documents that eliminated any mention of Leo Magers' history. That case is on appeal and California State Attorney General Bill Lockyer will be defending Paula Kamena and Kelly Vierira, the two prosecutors involved, according to Lockyer's spokeswoman, Else Cushman. This reporter has been following this case for the past five years and has all the documents involved in the Mardeusz matter.
When Mardeusz finished the call from the San Ramon Police Officer, she got on the phone with me and told me that Officer Chris Stangel had threatened to revoke her probation because she was lying to him. She was badly frightened, as anyone would be , when faced with additional jail time for a crime you did not commit.
I called Sgt. Telles back and he put me through to Officer Chris Stangel [employee no. 62357]. I asked him why he would threaten Mardeusz with a probation violation. I asked him if he had been in contact with Marin County and he became defensive. He said he knew about the Mardeusz case. Then he said, "I am a good friend of Paula Kamena [the Marin County District Attorney who survived a recall this year]. I used to work in Marin County and she is a good friend of law enforcement." I then asked him if his fellow response officer, Officer Schultz, was also a good friend of Paula Kamena and he said, "No, he does not know her personally, but after I tell him about her qualities, he will be a good friend."
Still naive, I thought this was something that Sgt. Jim Telles should know. When I contacted Sgt. Telles around 3:45 pm, his whole attitude had changed. No longer the "good cop", he had become "the bad cop". His voice was brisk and abrupt with a tinge of anger. He said he could no longer talk to me because this was a active investigation. I told him that was fine with me but I asked him to listen to the remarks made to me by Officer Stangel because it reflected his obvious bias BEFORE he had accessed the facts in the case. I wanted to put the bias on the record and I told Sgt. Telles I would be using Officer Chris Stangel's quotes in an article that would run today.
The Blue Line of Silence has thickened and lengthened over the past weekend. It will be interesting to see if Marin County will revoke the probation of Carol Mardeusz less then two weeks after trying to jail her again. A settlement. That settlement occurred just days before Ana Marie Cavazos Magers was found dead.
The Sonoma County Coroner confirmed that as of 4:19 pm Friday, December 14, 2001 the body of Mrs. Leo Magers (Ana Marie Cavazos) remained at their office. Leo Magers had not claimed his wife's body more than one week after her mysterious death.
