On November 12, 1999, Judge Thomas F. Hogan U.S. District Court, District of Columbia,  EXPLAINED THE FACTS OF LIFE TO YOU!  Do you have 3 minutes to read the facts of life--more effective than death, more mysterious than good sex--the CIA source of money, dough, loot, bread, whatever!   The case: Steven Aftergood on behalf of the Federation of American Scientists v. the CIA.

JUDGE HOGAN FIRST EXPLAINED THE BACKGROUND, OF COURSE! 

"Background Plaintiff Steven Aftergood, on behalf of the Federation of American Scientists, seeks disclosure under the Freedom of Information Act ("FOIA"), 5 U.S.C. §552, of the Administration's total budget request for fiscal year 1999 for all intelligence and intelligence-related activities. Defendant, the United States Central Intelligence Agency ("CIA"), denied plaintiff's request on the basis that the information is exempt from FOIA's disclosure requirements because it is properly classified under Executive Order 12958 in the interest of national defense or foreign policy (Exemption 1) and because release of this figure would tend to reveal intelligence sources and methods that are specifically exempted from disclosure by statute (Exemption 3). On December 11, 1998, the Defendant moved for summary judgment on the basis of three declarations from George J. Tenet, Director of Central Intelligence ("DCI"), one unclassified filed as an exhibit to Defendant's Motion for Summary Judgment, and two classified which were filed under seal and ex parte for the Court's in camera review. These declarations explain why DCI Tenet believes the release of the figure requested by Plaintiff could reasonably be expected to cause damage to the national security and would tend to reveal intelligence methods and sources."

 JUDGE HOGAN THEN EXPLAINED THE INFINITE MYSTERY!

"There is no single, separate appropriation for the CIA. Appropriations for the CIA and other agencies in the intelligence community are hidden in the various appropriation acts. Id. ¶21. The locations are not publicly identified, both to protect the classified nature of the intelligence programs that are funded and to protect the classified intelligence methods used to transfer funds to and between intelligence agencies. Id. Sections 5(a) and 8(b) of the CIA Act of 1949, 50 U.S.C. §§403f, 403j, provide the legal authorizations for the secret transfer and spending of intelligence funds. Id. ¶23. DCI Tenet has asserted that since there are a finite number of places, where intelligence funds may be hidden in the federal budget, a budget analyst could construct a hypothetical intelligence budget by aggregating suspected intelligence line items from the publicly-disclosed appropriations and that repeated disclosures of either the budget request or the budget appropriation would provide more data with which to test and refine the hypothesis. Id. Plaintiff denies the viability of this argument but provides no conclusive evidence of its implausibility."

JUDGE HOGAN THEN EXPLAINED THAT THE FOIA IS GARBAGE!

"Several courts have held that information tending to reveal the secret transfer and spending of intelligence funds is exempt from disclosure under FOIA as an "intelligence method." See, e.g., Military Audit Project v. Casey, 656 F.2d 724, 745 (D.C. Cir, 1981). Therefore, because DCI Tenet has determined that release of the total budget request would tend to reveal secret budgeting mechanisms constituting "intelligence methods," it is also exempt from disclosure under FOIA Exemption 3."

JUDGE HOGAN FINALLY, IN AN ORGY OF GOOD 'OLE BOY BLISS, ENDORSED THE LOGOS  OF CIA DIRECTOR TENET AND GENUFLECTED WITH INFINITE FAITH AT HIS HEAVENLY THRONE (TROUGH)!

"The Declarations of DCI Tenet logically establish that release of the Administration's budget request for fiscal year 1999 could reasonably be expected to result in harm to the national security and to reveal intelligence "sources and methods." On the basis of these declarations and the entire record in this case as well as the discussion above, this Court will grant the CIA's Motion for Summary Judgment. An order will accompany this Memorandum Opinion."  Ahhhhhh, Logic, you have cast your boring spell..............

PRESIDENT CLINTON PASSES OUT BIG BUCKS TO THE DEPARTMENT OF JUSTICE AND THE LOCAL PHONE COMPANIES TO SPY ON YOU AND YOURS!

Dateline 2/8/00:   President Clinton has filed his 1.84 TRILLION DOLLAR Year 2001 budget request (beginning October 1, 2000). AND THE BUDGETARY  TARGET IS FREEDOM OF TECHNOLOGY aka the means for  FREEDOM OF THOUGHT, thus action!  

THE BUDGET WILL PAY FOR MORE FEDERAL AND STATE WIRETAPPING.  Clinton proposes $15 to ******$240 million in payments to LOCAL telephone companies so they can set up their equipment to help the feds and states wiretap when they want to.  HOW MANY WIRETAPS WILL THE AMERICAN PUBLIC TOLERATE BEFORE THEY SEND THE TROJAN HORSES PACKING? 

HEADS UP! The 1994 Communications Assistance to Law Enforcement Act (the CALEA) allows the federal government to pay phone companies for their efforts to help the feds and states set up wiretaps on your phone lines.  Notice the ******in front of the budgetary sum of $240 million?  Half of that $240 million will be provided by the national security budget of the Department of Defense.  That means THE MILITARY IS PAYING $120 MILLION TO PAY OFF THE LOCAL PHONE COMPANIES TO TAP YOUR TELEPHONE LINES, SHOULD THE LOCAL D.A. OR US ATTORNEY HAVE AN ITCH TO DO SO!  (And is there ever an itch that is not scratched?)

ARE WE, SITTING AT OUR COMPUTER STATIONS,  JUST A BUNCH OF WIRETAP-READY SLAVES? ( If the prince has the means, the ends will be justified.)

In his fiscal year 2001 budget, President Clinton gives a $51 million increase to military intelligence and communications activities, which totals a $4.96 billion dollar allocation.  Is this a free bucket of cash to spy with!  And is the spying against foreign enemies or American citizens designated as "terrorists"?  Or is the spying just garden variety?

To citizens with short-term recall!  Remember how the sinister elements of the Department of Justice (one of the biggest cash cows in the U.S.) attacked President Clinton regarding his personal sex life ad nauseum.  This attack caused the American System of Justice, via so-called independent prosecutor Ken Starr (the intellectual equivalent of bad pudding) to be known world-wide as a SICK VOYEUR, at best, or as frat-type envious perverts, at worst.  But look at President Clinton's gratitude (or debt at not being indicted?)!  The White House budget plan requests 3.28 BILLION total for the Department of Justice.  (One might think Clinton is paying off the Department of Justice for something or other). The 3.28 BILLION includes:

       1.  A $100 MILLION DOLLAR INCREASE IN PAY FOR 94 EXISTING U.S. ATTORNEYS AND THEIR 10,000 AIDES.  Allegedly this extra $100 mill will pay for firearm and pornography investigations an increase prosecutions of computer crime and theft of intellectual property.  (The biggest money is in computers and pornography--drug dealing is a little passé?) 

       2.  11.4 MILLION to hire forensic experts to retrieve and enhance examinations of computer evidence.  (This means no hard drive or disk in this country is safe!)

       3.  100 MILLION for "automated data processing and telecommunications and technical investigation equipment" a $50 MILLION INCREASE!

         4.  300 MILLION for "counter-terrorism."  

       5.  $5 MILLION to combine the INS's fingerprint program with the FBI's fingerprint data base.

       6.  $4.3 MILLION to "implement a Public Key Infrastructure" for the Justice Department's computer network.  (If anyone can explain what this means,  NEWSMAKINGNEWS will send to first person with the answer a $100 cash prize! E-mail your winning entry!)  Nothing like paying Millions to support the inexplicable seeking the fruition of the unexplainable!

       7.  An increase of $24 million to pay for antitrust investigations and lawsuits.  Looks like Bill Gates was blood in the mouth of the shark!  As foreign competitors (sometime banditos of U.S. technology, and the strangest bedfellow on the planet) smile!

       8.  $1 MILLION for the DOJ to set up its a newsletter and publications as its own "communications network."  Do we really have to hear more disinformation from these overpaid sophomores with a small army known as the FBI?  Disinformation about such extremely serious matters as the burning of citizens at WACO?  The suppression of data about John Doe No. 2's at Oklahoma City?  The failure of the U.S. attorneys to stop the kidnap and killing of American children throughout America?  

       9.  $10 MILLION to develop "gun detection and childproof technologies."  

      10.  $1.87 MILLION paid to the FBI to create a "Joint Automated Booking System" so the FBI can monitor "arrests" and have a "current, nationwide reference for criminal offenders, arrest, cases and related data" including images and fingerprints. (NEWSMAKINGNEWS notes that a citizen does not have to be CONVICTED OF A CRIME to be logged into this stew of data!  So-called "related data" is being collected which includes images and fingerprints.  An "arrest" is not a conviction in the U.S.A.  Or is it?
