RARE PARASITIC DISEASE KILLS 21 DOGS.

MILLBROOK, N.Y., Aug 25, 2000 (AP Online via COMTEX) -- A parasitic disease
rarely found in this country has killed 21 foxhounds and has sickened at least 20 others,
prompting the national fox-hunting organization to cancel events. The disease can also
affect humans.

One after another, the hounds at Millbrook Hunt in Dutchess County became lethargic. Losing weight and patches of hair, the dogs developed enlarged joints, crusty skin lesions and rope-l ike knots underneath their skin.

The culprit was identified this spring by researchers at North Carolina State University as a strain of leishmaniasis, typically found in warm, coastal areas like Brazil, the Mediterranean, India and the Sudan.

Normally transmitted by sand flies, the disease is considered curable in humans, but it has killed people in other countries. It has rarely been diagnosed in the United States.

Among foxhounds, the disease has been found in kennels in 20 states and Canada, but only the Millbrook hounds have died.

"This should not be in the U.S.," Edward B. Breitschwerdt, professor of medicine and infectious diseases at North Carolina State, told The New York Times. "We're truly dealing with a foreign animal disease that remains very unclear to all of us still."

The Centers for Disease Control and Prevention is testing people who have come into contact with the foxhounds in Millbrook and collecting samples from 10,000 dogs around the country.

While 12 percent of the 9,000 hounds tested so far have shown some blood-test evidence of infection, only 1 percent have been confirmed as being infected, said Dr. Peter Schantz, a veterinarian and epidemiologist in the CDC's division of parasitic diseases.

The Millbrook dogs started dying a year ago.

This spring, the Masters of Foxhounds Association, the sport's national governing body, canceled all fox-hunting events and urged kennels to quarantine leishmaniasis-positive dogs.

"We're being super-cautious, because nobody knows all the answers," said Dennis Foster, the organization's executive director. "If there's any question, we don't do it, that's our philosophy."

Rigged software claimed to hack intelligence files

OTTAWA - The RCMP is conducting a probe related to allegations that foreign spies used rigged software to hack into Canada's top secret intelligence files.

A Star investigation has found the probe revolves around stunning claims that computer software used by the Mounties and Canada's spy service to co-ordinate secret investigations was rigged with a ``trap door'' to allow American and Israeli agents to eavesdrop.

If this proves true, it would be the biggest ever breach of Canada's national security.

Computer experts say a sophisticated trap door - essentially a computer bug - can be impossible to find, even if you know it's there. They can be hidden in either software, as a tiny bit of rogue code, or in the computer's hardware, stored on a microchip.

While Canada already shares a wealth of intelligence information with the U.S. and Israel, there are many elements of Canadian intelligence gathering that the government wouldn't be anxious to share with allies.

Joint owner of Inslaw Inc., the Washington-based company that developed Promis. He refused to say whether the Mounties have contacted him.

That could include economic intelligence on trading partners, detailed information on the whereabouts of terrorism suspects in Canada or strategic information on the positions Canada intends to take in international relations.

The RCMP would not formally confirm the existence of the probe by its National Securities Investigation section.

``I cannot either confirm or deny what you're looking into,'' RCMP spokesperson Sergeant Marc Richer said yesterday.

But sources close to the investigation say it revolves around Promis, a software program first developed to assist prosecutors in the United States Department of Justice. The case management software also has application for intelligence agencies keeping track of surveillance and investigation files.

The Promis software was at the centre of a major U.S. scandal a decade ago.

Bill and Nancy Hamilton, owners of Washington-based Inslaw Inc., the company that developed Promis, caused a sensation when they alleged the U.S. government had stolen their software and pedalled pirated versions to intelligence agencies around the world.

A former Israeli spy also alleged the software had been fitted with an electronic trap door to allow American and Israeli agents to spy on those who used the software.

After a series of contradictory court rulings and investigations, the story dropped out of the headlines years ago. But now, a Star investigation has found that a number of people linked to the Promis affair have been interviewed by RCMP investigators in recent months.

Louis Buffardi, a lawyer who represents an American computer wizard, who claims he helped prepare Promis software for sale to Canada, said his client was interviewed by RCMP officers who said they are probing a possible breach of Canada's national security.

A former stockbroker, John Belton, who lives in Eastern Ontario and has been tracking the Promis case for years, said RCMP investigators have made repeated trips to his home to conduct interviews on the subject.

Another player in the saga, who asked not to be identified, said RCMP investigators have talked to him about their concerns that Canada's national security may have been breached.

Sources said Bill Hamilton was among those interviewed by the RCMP. Reached in Washington yesterday, Hamilton refused to say whether or not the Mounties had talked to him, but said he was glad to hear there was an investigation.

``We welcome any credible and serious investigation of this affair,'' Hamilton said.

The Promis case was never fully resolved in the U.S. but many regard it as the domain of conspiracy theorists.

In 1987, a U.S. court upheld some of the software company's claims of stolen software and found there was evidence the U.S. justice department used ``trickery, fraud and deceit,'' to steal the Promis software from Inslaw Inc.

That ruling was later overturned on procedural grounds. And in 1993, the report of a retired judge hired to probe the matter concluded there was no credible evidence the software had been stolen by the justice department.

(Inslaw's Promis software is still in use in some U.S. prosecutors' offices and available for sale legitimately.)

The Canadian government entered the story - publicly, at least - in 1991.

That's when a federal bureaucrat called Inslaw with a routine request: Was the Promis software, already in use by some government departments, also available in French?

Trouble was, Inslaw hadn't sold its product to anyone in Canada.

Inslaw started asking questions in Ottawa, where officials quickly backtracked. There had been a mix-up, they said, some confusion about the name of the software.

Officials insisted at the time no government department was using Inslaw's Promis.

Yesterday, RCMP Corporal Glen Kibsey refused to comment on whether the RCMP uses Promis software.

A spokesperson for CSIS, the spy service, also refused to comment on what software the agency uses, or the reports of an RCMP investigation.

U.S. embassy spokesperson Buck Shinkman said he was not aware of any RCMP investigation, or any developments in the Promis file.

``I'm unaware of any renewed interest in this story,'' Shinkman said.

A spokesperson at the Israeli embassy could not be reached for comment.

The former Ontario stockbroker involved in Promis affair said he has been interviewed by the Mounties numerous times over the last 18 months.

Belton said RCMP officers told him they are investigating whether the Mounties have Inslaw's Promis software, if it was stolen, and whether the security of the RCMP has been compromised as a result of trap doors in the software.

He said he's aware some people will regard him as someone who lives in a fantasy world of conspiracy theories and spooks.

``You're not dealing with paranoid crazies, or the UFO guys. I'm very serious about this,'' Belton said.

He said the proof that his allegations are being taken seriously is the fact that RCMP investigators have been coming to see him for 1 1/2 years to discuss the evidence he has to offer.

Belton said RCMP officers have already confirmed to him that they do use the Promis software and have told Hamilton his software was in use by the Mounties.

The chainsmoking Belton unraveled his story at the kitchen table of his sprawling, ramshackle house near Ottawa. The table is stacked with thick binders jammed with documents detailing his allegations.

Court documents, detailed notes of telephone conversations and newspaper clippings are marked up with highlighter and neatly organized.

In addition to Belton, an Illinois lawyer representing Riconoscuito - the American computer whiz who has publicly claimed he helped prepare Inslaw's Promis software for sale to Canada in 1983 and 1984 - said in an interview that RCMP investigators talked to his client.

``I was first contacted by the RCMP, oh geez, eight or nine months ago,'' Riconoscuito's lawyer Louis Buffardi said.

Buffardi said the RCMP investigator told him the matter involved a possible breach of Canada's national security.

Police were interested both in going over Riconoscuito's previous claims about his involvement in modifying the Promis software, as well as asking him about some new information, the lawyer said.

``Some of the modifications that I made were specifically designed to facilitate the implementation of Promis with two agencies of Canada: the Royal Canadian Mounted Police and the Canadian Security Intelligence Service,'' Riconoscuito once said in a sworn affidavit.

Riconoscuito, who is currently being held at a federal prison in Pennsylvania on drug charges, couldn't be reached for comment.

Another player in the saga, who asked not to be identified, also confirmed he has been contacted by RCMP investigators who want to question him about the Promis software.

But another person who sources claimed was on the RCMP interview list - Madison Brewer, who managed the Promis software project at the U.S. Department of Justice in the 1980s - said the allegations were fantasy.

``The people who make these accusations are just crazies,'' said Brewer, insisting he has had no contact with the RCMP.

Brewer said the Promis software wasn't all that it was cracked up to be and that Inslaw fomented the scandal as ``a bunch of public relations crap.''

The lead RCMP investigator working on the file, Sean McDade, was reached by telephone this week but refused to divulge any information about the probe.

``You're putting me in a bad spot here. I can't comment on what's happening right now,'' McDade said.

``There's issues that I am not able to talk about and have nothing to do with what you're probably making inquiries about.

``It's a matter that is under investigation - not that Inslaw is under investigation by any sense, but certain elements have just twigged my interest and that's it. There is no official investigation that I can talk to you about right now.''

McDade also warned reporters to be wary of the web of intrigue surrounding the affair. ``I kind of get a chuckle out of how something so small has been blown out of proportion.''

But a history of Israel's Mossad published last year suggests the software did wind up in Canada.

In his book, Gideon's Spies, Welsh author Gordon Thomas recounts the tale of how Rafi Eitan, former deputy director of operations at Mossad, claimed that both Israel and the United States had sold modified Promis software to other countries through front companies.

Another of the characters linked to the affair is Ari Ben-Menashe, a former Israeli intelligence agent now living in Montreal. He claimed in his book, Profits of War, that he played a role in having a trap door installed in the Promis software, which was then distributed around the world. He wrote that the Americans and the Israelis sold the doctored software to many countries, including Canada, Britain, Australia, South Korea, Iraq, Brazil, Chile, Colombia and Nicaragua.

In an interview, Ben-Menashe said Canadian authorities quizzed him about Promis seven years ago in the course of security screening interviews after he applied for Canadian citizenship.

But Ben-Menashe, who now runs a security consulting firm in Montreal, was adamant that he has had no contact with the RCMP in connection with the Promis affair.

While the Promis story line sounds like a Le Carre novel, intelligence experts say it is not entirely implausible that some of Canada's close allies would use software to spy on this country.

Even the RCMP officers investigating the affair use a mysterious electronic mail address to pass messages. The e-mail address includes the word Promis, spelled backwards - simorp.

Experts say a sophisticated trap door can be impossible to find. The trap door code is tucked within hundreds of thousands of lines of programming instructions.

A hacker can activate it with a specific set of key strokes and then use it to download all the information on a database - completely undetected.

A micro-chip trap door would have to be implanted in the computer main frame, likely replacing a chip that's actually supposed to be there.

It allows a hacker to used a modem to dial into the central computer and pull out any interesting information stored there.

As Clinton prepares to distribute $1.3 billion in "aid" to Colombia, the ole' war industrialists prepare to feather their coffers.

But the tab doesn't stop at $300 million (about $15,800 per acre). Another $200 million ($10,500 per acre) would be required to clean up of this "toxic" dump. Yes, man creates toxics of natural products when it "over concentrates" them, as in the case of the salt flats. And oil, and gas, and sulphur, etc.  

A recent example of damage caused by wine came to light with the Kornell wine warehouse fire this past June in Napa County. Though heavily diluted by water, the natural acids in the wine that spewed from exploding bottles were strong enough to kill grapevines in adjoining vineyards. In an article by Robert Salladay and Jane Kay of "The San Francisco Examiner" (Click to read), Cargill admits "(it) is scaling back its operation to concentrate on finer grained salt used in drugs instead of food. As a result, 19,000 acres of valuable land is up for sale...." 

One might question the term "valuable." Cargill is faced with the typical problems of a  "discontinued operation." The seller is responsible under the laws of the State of California to pay the cost of toxic clean-up. And salt kills, no doubt about it. Cargill's flats are a disaster. Why are S.F. Mayor Willie Brown and U.S. Senator Diane Feinstein so eager to spend our tax dollars to enrich Cargill? It can well-afford to handle the normal costs associated with discontinued operations and toxics clean-up. In a similar fashion, Cargill decided to abandon its North Bay salt flats in Sonoma - Napa Counties. The area totaled 9,850 acres and sold to conservation  interests at $10,000,000, or only $1,015 per acre. And to boot, just this past January Mary Fricker of "The Press Democrat" announced that a lawsuit brought in the U.S. District Court against Cargill for "overcharging" was unsealed (Click to read.

SUDDENLY CARGILL'S FLATS ARE PRICELESS Why the sudden increase in the price per acre in six years? From $1,015 per acre in the North Bay to $15,800 per acre in the South Bay? That's a whopping multiplier of 15 x. And the timing? When Cargill is being pressed through litigation to not only abandon its sale price of $1,015, but cough up the money needed to clean up the North Bay land? The "play" contemplated by Senator Feinstein and entourage would obviously negate the argument of the plaintiffs in the recently filed Federal action concerning the North Bay properties.  It would spare Cargill "loose change" in the extant litigation. Double entrendre. Bay Area residents, be reminded that Buttes Gas & Oil operated the Gambonini quicksilver mine in Marin County and killed off Tomales Bay. Did Buttes successor Reunion Industries suffer the consequences?  

It was reported as "devoid of assets" to foot clean-up costs (while now scott free to sell off prime country properties in Napa for $17 million to developers). So, the Gambonini toxic dump is being cleaned up with Federal Super Fund monies. But is Cargill devoid of assets to handle its own messes? Hardly, not with $46 billion in annual revenues. 

ANOTHER SPOOK CONNECTION? What's the rush? What's the inside deal here? Why the sudden rip-off, sudden urgency to push this deal through? During World War II, companies such as Kaiser and Cargill were indistinguishable from the Federal government. Their income was pure government, Kaiser from ship and war machinery construction, Cargill from ship-building (Minneapolis) and commodities contracts. Since that time they have served the government through their intricate "spook" channels, with layers of their companies and personnel (such as Bush fund-raiser Gene Trefethen of Kaiser, then Trefethen Winery) stepping to the forefront to provide private channels to aid the Contra cause. Ollie North knew who he could rely on in the "private" sector. Ollie did a good job of protecting these assets -- remember Fern Hall, remember the document shredding episode about which Ollie also testified? Somehow all of his notes and records about private contributors were shredded. (Ref: Peter Dale Scott's "Cocaine Politics," and Joseph Persico's "Casey"). 

It doesn't take much of a brain to realize that Cargill was involved in monkey business during Iran-Contra.  At least one of their operations in California surfaced in state records.  Cargill Marine and Terminal was created strategically in 1985, while there was a dry-up in funds to the Contras due to the Boland Act. Click to see it was subsequently "surrendered." Cargill Marine and Terminal probably ducked for cover into the U.S. Federal bankruptcy system when the fuel hit the fan about Ollie's "Triad" and "enterprises" in 1987-88. As to all that "bunk" about Cargill having been around since the Gold Rush - the fact is that Cargill acquired the salt flats from Leslie Salt in 1978. It was Isaac Friedlander who amassed a fortune cornering wheat and sailing vessels in San Francisco, only to die in 1878, one year after losing his Gold Rush fortune. 

BUT THIS CONTEMPLATED LARGESSE is indeed CARGILL'S GOLD RUSH. Cargill was in the Midwest and stayed in the Midwest, non-existent during California's Gold Rush. It narrowly avoided bankruptcy in 1909 when its founder died. The wars of the 20th century brought wealth and expansion on global scales. Cargill expanded during the Depression.  But World War II was Cargill's Gold Rush. Wars are good for grain companies like Cargill. They admit their business, which competes in the international theater, is a "highly competitive, narrow margin business." Enter a war, however, and the profits zoom to astronomical levels under government contracts. (Ref: Dan Morgan's "Merchants of Grain).  

In 1979 Dan Morgan wrote: "Colombia is a good example of what is happening in dozens of other countries. The UN's Food and Agriculture Organizations says that this Latin American country has the capability to be a major exporter of food." So instead, what did the government of Colombia do?  They adopted a domestic policy that hurts the poor and helps Cargill.  

In 1977, President Alfonso Lopez Michelsen was forced to announce that foodstuffs, as well as some manufactured goods, would have to be imported in order to combat growing shortages and prevent speculators.  

Failing to subsidize or stimulate local markets caused a downward spiral for Colombia and major gains for Cargill. Is Cargill going to take the profits of these rip-off salt flat sales to spread them about now in war profiteering in Latin America? You can help stop the Cargill sham by forwarding this information to every Senator you can think of in California and in Washington, D.C. Go to http://www.senate.gov  select "senators" and start rolling this through their email systems.

Mayor criticizes environmentalists who oppose bill

SACRAMENTO - For the first time since leaving the Legislature five years ago, Mayor Willie Brown traveled to the Capitol to testify on a bill, but his appearance did nothing to resolve a dispute between environmentalists and San Francisco International Airport.

Although Brown got his bill passed Tuesday, the former Assembly speaker left complaining that environmentalists were "being real stupid" in opposing his plan for the government to buy salt ponds in the South Bay.

Brown believes buying and restoring 19,000 acres of Cargill Inc. land for migratory birds would be the perfect antidote for the damage caused when the San Francisco airport expansion fills in more than 1,000 acres of Bay for a new runway.

"It just happened to come before us, the salt flats on Cargill's property," said Brown, not mentioning that federal officials have been looking at buying the land for two years. "The Bay watchers took me up in an airplane and showed me all the places and the spots, and it is an enormous potential undertaking."

But Cargill said it wouldn't sell the land, near Newark and San Jose, if the deal came under conditions approved Tuesday by the Senate Natural Resources Committee. The bill, supported by Brown and written by Assemblywoman Carole Migden, D-San Francisco, now heads to the Senate Appropriations Committee.

Cargill believes the measure is vague and could mean a five-year wait before it is paid for the marshland it has owned since the Gold Rush. The land is home to 70 species of shorebirds and migratory fowl, and is estimated to be worth $300 million.

As the Migden bill is written, Cargill and environmentalists believe the purchase can happen only when SFO is ready to pay to restore the area.

But that money - up to $200 million - most likely won't be available for years, if ever, after environmental reviews are completed on the expansion.

Cargill said it might be forced to start simply selling the land piecemeal rather than wait for the airport environmental reviews and the state to cut a check. It would rather just sell the land to the state

and federal government now and have the state worry about restoring the land later.

Wants to be paid soon

"If in reality what this means is a significant delay, then yes, that's a problem," said Cargill spokeswoman Lori Johnson, who attended the hearing Tuesday. "Our interest is: If we are going to do this acquisition, we need to do it in a timely manner."

But Migden refused Tuesday to take out language that environmentalists and Cargill believe would kill the sale. The measure continues to say the Cargill sale cannot go through until money to restore the property is found.

So far, the only public agency with money to restore the property is, in fact, the airport.

Migden did make one amendment Tuesday: she removed $150 million from the bill, sending the issue instead to the Senate Appropriations Committee, where lawmakers will haggle over how much to spend on the Cargill purchase.

In Washington, U.S. Sen. Dianne Feinstein is pursuing another $150 million for Cargill, but only if the Legislature and Gov. Davis approve California's half by the end of next week, the final day of the 1999-2000 legislative session.

Both Migden and Brown acknowledged their first interest was to get the airport expansion approved. But they said the Cargill land should be set aside until a fickle Congress was ready and able to spend its half.

At worst, the state and federal governments will have purchased valuable land and preserved it. At best, the airport also will have a place to spend its $200 million and restore the land.

'A golden opportunity'

"When I was presented with this airport runway project, I knew it presented a golden opportunity for magnificent mitigation," Brown said. "Everybody already knows the airport has budgeted $200 million for mitigation and would like it spent on a project that will be forever. This potential restoration project will be forever."

But Davis Lewis, executive director of the preservation group Save the Bay, said the airport saw an opportunity to take credit for

saving the Cargill wetlands before the property slipped from its grip. So the airport, he said, is trying to step in before federal wildlife officials purchase the land and claim credit.

This also is the central worry among environmentalists about the Migden bill: If the state buys the Cargill land, it adds pressure to approve the airport expansion. The state will have spent $150 million on a piece of property in exchange for the runway expansion, even before it has gone through environmental review.

"The airport is trying to get a PR win here. They want to be able to claim: 'We delivered the salt ponds, now we're owed the runway,' " Lewis said. "That's why they are doing this now. The whole thing came about because wildlife agencies wanted to purchase it."

Lewis said the airport should wait until the environmental review was finished, and then look for a way to spend its $200 million on restoring property elsewhere.

"The airport should want the ponds to be purchased," Lewis said. "There is going to be plenty of need for their restoration funds if and when their project is approved."

After the hearing, Brown rushed away, but did say the airport was a critical asset and that environmentalists were making a mistake.

SACRAMENTO - For the first time since leaving the Legislature five years ago, Mayor Willie Brown traveled to the Capitol to testify on a bill, but his appearance did nothing to resolve a dispute between environmentalists and San Francisco International Airport.

Although Brown got his bill passed Tuesday, the former Assembly speaker left complaining that environmentalists were "being real stupid" in opposing his plan for the government to buy salt ponds in the South Bay.

Brown believes buying and restoring 19,000 acres of Cargill Inc. land for migratory birds would be the perfect antidote for the damage caused when the San Francisco airport expansion fills in more than 1,000 acres of Bay for a new runway.

"It just happened to come before us, the salt flats on Cargill's property," said Brown, not mentioning that federal officials have been looking at buying the land for two years. "The Bay watchers took me up in an airplane and showed me all the places and the spots, and it is an enormous potential undertaking."

But Cargill said it wouldn't sell the land, near Newark and San Jose, if the deal came under conditions approved Tuesday by the Senate Natural Resources Committee. The bill, supported by Brown and written by Assemblywoman Carole Migden, D-San Francisco, now heads to the Senate Appropriations Committee.

Cargill believes the measure is vague and could mean a five-year wait before it is paid for the marshland it has owned since the Gold Rush. The land is home to 70 species of shorebirds and migratory fowl, and is estimated to be worth $300 million.

As the Migden bill is written, Cargill and environmentalists believe the purchase can happen only when SFO is ready to pay to restore the area.

But that money - up to $200 million - most likely won't be available for years, if ever, after environmental reviews are completed on the expansion.

Cargill said it might be forced to start simply selling the land piecemeal rather than wait for the airport environmental reviews and the state to cut a check. It would rather just sell the land to the state and federal government now and have the state worry about restoring the land later.

"If in reality what this means is a significant delay, then yes, that's a problem," said Cargill spokeswoman Lori Johnson, who attended the hearing Tuesday. "Our interest is: If we are going to do this acquisition, we need to do it in a timely manner."

But Migden refused Tuesday to take out language that environmentalists and Cargill believe would kill the sale. The measure continues to say the Cargill sale cannot go through until money to restore the property is found.

So far, the only public agency with money to restore the property is, in fact, the airport.

Migden did make one amendment Tuesday: she removed $150 million from the bill, sending the issue instead to the Senate Appropriations Committee, where lawmakers will haggle over how much to spend on the Cargill purchase.

In Washington, U.S. Sen. Dianne Feinstein is pursuing another $150 million for Cargill, but only if the Legislature and Gov. Davis approve California's half by the end of next week, the final day of the 1999-2000 legislative session.

Both Migden and Brown acknowledged their first interest was to get the airport expansion approved. But they said the Cargill land should be set aside until a fickle Congress was ready and able to spend its half.

At worst, the state and federal governments will have purchased valuable land and preserved it. At best, the airport also will have a place to spend its $200 million and restore the land.

"When I was presented with this airport runway project, I knew it presented a golden opportunity for magnificent mitigation," Brown said. "Everybody already knows the airport has budgeted $200 million for mitigation and would like it spent on a project that will be forever. This potential restoration project will be forever."

But Davis Lewis, executive director of the preservation group Save the Bay, said the airport saw an opportunity to take credit for saving the Cargill wetlands before the property slipped from its grip. So the airport, he said, is trying to step in before federal wildlife officials purchase the land and claim credit.

This also is the central worry among environmentalists about the Migden bill: If the state buys the Cargill land, it adds pressure to approve the airport expansion. The state will have spent $150 million on a piece of property in exchange for the runway expansion, even before it has gone through environmental review.

"The airport is trying to get a PR win here. They want to be able to claim: "We delivered the salt ponds, now we're owed the runway,' " Lewis said. "That's why they are doing this now. The whole thing came about because wildlife agencies wanted to purchase it."

Lewis said the airport should wait until the environmental review was finished, and then look for a way to spend its $200 million on restoring property elsewhere.

"The airport should want the ponds to be purchased," Lewis said. "There is going to be plenty of need for their restoration funds if and when their project is approved."

After the hearing, Brown rushed away, but did say the airport was a critical asset and that environmentalists were making a mistake.

SALT SHAKER -HEALDSBURG MAN SUES OVER WETLANDS PRICE

A debate over how to value environmental land purchased for preservation has focused on the North Bay, where a lawsuit accuses Cargill Inc., the nation's largest private company, of overcharging state and federal agencies at least $10 million for salt evaporation ponds officials hoped to restore to tidal wetlands.

The lawsuit, brought by a Healdsburg man critical of the acquisition, has received national attention after a federal judge unsealed the case documents and claims last month. The suit accuses Cargill of using a ``bogus and fraudulent'' appraisal method to justify a $10 million price tag for 9,850 acres of abandoned salt ponds, levees and sloughs at the north edge of San Pablo Bay between the Napa River and Sonoma Creek.

The complaint in U.S. District Court in Oakland argues that the property actually had a ``negative fair market value'' because of the cost of cleaning up after the salt operations.

Cargill, a Minnetonka, Minn., company that trades and processes foodstuffs and commodities, has extensive salt-making operations on the San Francisco and San Pablo bays. With 82,000 employees worldwide and offices in 59 countries, it had $46 billion in sales last year.

The lawsuit was filed by Healdsburg resident John Hansen, a carpenter and former volunteer game warden who has taken up a crusade to police what governments pay for private land in order to preserve it.

``This was a sweetheart deal, substantially swept into being by the prowess of Cargill's political weight,'' said Hansen, who founded the small nonprofit Integrity in Natural Resources, which analyzes the economic, scientific and other data used in conservation agreements. Cargill argues, however, that the sale was sought by environmental groups and government agencies and the price paid for the land was substantially below its market value.

Hansen, who is represented by Novato attorney Daniel R. Bartley, filed his complaint in 1998 under the False Claims Act, which lets private citizens sue on behalf of the government. It was sealed and remained confidential while the U.S. Department of Justice and the state Attorney General's Office decided whether to join Hansen in the case. They decided not to intervene and the complaint was unsealed.

Hansen's view

Hansen's view is that taxpayers should not pay more for conservation land than a private person would pay, unless the reasons are clearly disclosed. The view has been backed publicly by leading professional appraisal organizations and the Department of Justice.

``In filing this action, I'm trying to make sure the limited dollars spent for conservation lands for the public are really for the public, not dollars to fill corporate coffers,'' Hansen said.

But others believe some conservation land is worth more to the public than to a private person and should be valued at a higher price.

In the Cargill matter, Hansen claims Cargill knowingly used an appraisal that assigned an inflated value to the property. He also is suing Cargill's appraiser, Craig D. Hungerford, and his company Real Estate Dynamics Inc. of Madison, Wis.

On Thursday, Hungerford declined to comment because he had not seen the lawsuit, but Cargill spokeswoman Lori Johnson defended Cargill's sale and pointed out that the transaction was reviewed and approved by several government agencies.

`Bargain-basement price'

``One thousand dollars an acre for this property was a steal. It was a bargain-basement price recognized by everyone,'' Johnson said. ``All of the agencies involved still say this is one of the best deals for the state of California in California history.''

She said several environmental groups and government agencies had begged the company to sell the property so it could be returned to its historic condition as tidal marsh.

``If wetlands are believed to be so valuable, you are not going to be able to accomplish public goals unless there's a method for incentivizing a landowner to sell you their property,'' Johnson said.

Will Travis, a state official responsible for the negotiations with Cargill in the early 1990s, said he views the acquisition -- which is the largest wetlands acquisition and restoration project in the history of California -- as a major accomplishment.

``Of all the things I've done in my professional career, getting that land acquired so it could be re stored is at the top of the list,'' Travis said. ``I'm extraordinarily proud of it.''

In his complaint, Hansen accuses Cargill, Real Estate Dynamics and Hungerford of making a series of false claims to justify an inflated sales price and of conspiring to defraud the government. He estimates damages at $10 million plus cleanup costs.

The complaint asks the judge to determine the actual market value of the site and to order the defendants to pay the United States and the state of California three times the amount they have been damaged, plus fines, and to pay Hansen ``the maximum amount allowed`` -- which is 25 to 50 percent of any recovery, Bartley said -- plus attorneys' fees and costs.

Drawing attention

Hansen's case has drawn the attention of natural resource experts across the country, particularly appraisers, because it tackles the thorny issue of how to value environmental land, especially when it has social value but little or no economic value.

With more than $1 billion a year now being allocated nationwide to acquire conservation land, much of it coming from taxpayers, the stakes have risen on how the issue is resolved.

Bartley said the case could set a precedent that could have implications for land purchases across the country.

Closer to home, it could impact a half-dozen wetlands transactions around the Bay Area as well as San Francisco Airport's efforts to expand its runways into the San Francisco Bay. For the airport's plans to move ahead, some have proposed it could mitigate the environmental damage to the Bay by buying and restoring Cargill's 29,000 acres of salt ponds in the South Bay.

The first hearing in the Hansen case is set for April 7 in U.S. District Court in San Francisco.

When the story began

The Cargill salt pond story began in April 1988 when the Shell Oil Co.'s refinery in Martinez spilled about 400,000 gallons of crude oil into San Francisco Bay.

To settle claims brought by 15 federal, state and local agencies, Shell agreed to pay $10.8 million into a trust fund to be used to restore and acquire natural resources. A trustee committee of six public agencies was formed to spend the money, with Travis as chairman, and in 1992 it approached Cargill with an offer to buy the North Bay salt ponds.

Cargill, which had harvested salt at the site since 1959, was selling the salt to a Dow Chemical Co. chlorine plant in Pittsburg, but that plant closed in 1990 and Cargill had been unable to find another customer.

At first, the trustee committee said it would select and hire an appraiser, but Cargill objected and eventually selected Hungerford as the appraiser and paid for his work. He established a value of $34.8 million, or $3,533 per acre.

Cargill said it would accept $10 million and would apply to the IRS for a tax deduction based on a $24 million charitable donation. A deal was struck, even though in 1991 state officials had criticized and rejected a similar appraisal of Cargill property in the South Bay, by the same appraiser and using the same appraisal methods.

In 1994, the trustee committee paid Cargill $6.5 million for the site, state agencies paid $2.75 million and $750,000 came from a national conservation grant. Cargill also reduced its taxes by an undisclosed amount.

The Hungerford appraisal is at the heart of Hansen's lawsuit.

His complaint's central concern is that the appraisal claims to establish market value but it is based mainly on what government agencies and nonprofits have sometimes paid to acquire conservation land, such as wetlands.

This type of appraisal, often called a ``public interest value'' appraisal, is different from a conventional appraisal, which is based on what private parties would pay to acquire the land for economic purposes.

Public interest value

A public interest value appraisal usually arrives at a higher value than a conventional appraisal.

Public interest value appraisals are a hotly debated topic in the appraisal industry today, with the discussion centered mainly on whether public interest value is essentially the same as market value.

Market value

Market value is what a willing buyer would pay a willing seller to acquire property for its ``highest and best use'' when the parties are operating freely in a competitive and open market for their own self interest.

Hungerford has been a leading proponent of the public interest value concept, arguing in professional publications that if individuals or organizations pay money to acquire and preserve environmentally significant real estate, that establishes a market value.

The Department of Justice and leading U.S. appraisal associations, including the 19,000-member Chicago-based Appraisal Institute, have concluded that public interest value appraisals do not establish market value and on public land purchases that require market-value appraisals, public interest values cannot be used. The institute spent 2-1/2 years studying the issue.

However, the state Department of Real Estate Appraisers, California's licensing agency for property appraisers, approved of Hungerford's methods in the Cargill appraisal.

In Sonoma County, the county's open space district recently discussed appraisals based on public interest values, but it has no plans to permit their use, according to general manager Steve Sharp.

Hansen's complaint alleges that the Cargill property actually had a negative value because of the cost of cleaning up the salt ponds. In order to restore the ponds to tidal wetlands, the salted waters will have to be diluted and carefully discharged into the Bay over many years to avoid environmental damage.

Studies under way

Studies are under way to analyze restoration possibilities, and government officials recently estimated the cost of restoring some of the ponds to tidal habitat at $6.5 million.

Hungerford's analysis allocated $1 million for cleanup.

Currently, the state Department of Fish & Game, which is managing the property -- with its 7,300 acres of salt ponds and 52 miles of levees -- does not have the funds for restoration, and only one of the 12 ponds has thus far been restored.

 Well it's official; or darn close to it. We've had it confirmed by a radio electronics expert using sophisticated equipment that the principal behind the NewsHawk operation -- that's me, John Quinn -- is apparently being subjected to a continual assault from a "directed energy" weapon, using electromagnetic/radio-frequency technology. 

NewsHawk has published investigative articles about things like this so often, apparently feds decided I needed a dose of it myself. And it seems I'm getting it. 

On-site research here by an electronics technician strongly suggests that some sort of low-frequency signal (ELF/ULF) is being targeted at me, which has the interesting effect of resonating with(in) the skeletal structure, at which point it is converted into a subtle humming sound then perceived by the inner ear; it is not transmitted as a normal audio frequency which is heard by means of the body's normal auditory mechanisms. 

So--the question is: how could this be primarily affecting only myself, although several others have in fact noticed the effect at times? 

We've noted in our reports on the Montauk Project that state-of-the-art EM/RF mind/mood control technology is said to have been developed to the point where the specific electromagnetic "signature" of any individual person (or just about any individual life-form for that matter) can be isolated and codified, and that this unfortunate individual can then be SPECIFICALLY targeted with precisely tuned frequencies which will affect ONLY the targeted person(s), although there is apparently some impact on people with similar genetic or physiological makeup and/or people in close proximity to the target(s). 

By all evidence, this is the kind of weapon that's being used against myself. 

It turns out in retrospect that this apparent assault has in fact been going on for at least a year and a half, but evidently malevolent system operators have amped up the gain of the signal transmission to the point where the EM/RF bombardment has been hard not to notice, even for some other people who are likely not directly targeted. 

It's also a near-certainty that the signal is being transmitted by satellite, as it's been picked up in widely separated locations. 

Clearly, my journalistic activities in the past couple of years are what precipitated this assault upon me. This latest, stepped-up assault would seem clearly to have been brought about by the resumption of our Internet news service--in particular, our articles about the massive hi-tech weather war being carried out by the covert government. 

Further investigation will be made into this apparent directed-energy weapons activity directed against me. If the results show with relative certainty that what seems to be going on IS in fact genuinely going on, I will be placed in a difficult position. 

Due to my life circumstances in general, it would be inadvisable for me to continue in activities which would have brought such an assault about. 

Regretfully, if it becomes clear that I am being targeted with EM/RF weaponry, it will be necessary for me to discontinue NewsHawk's news service.

Now look at the life advise given on all the TV sit coms. Have sex with anyone whenever you get the urge. Homosexuality? Try it. You may be that way. Do you think Rupert Murdock gives this advice to his kids? Or Edgar Bronfman? They tell their kids to be very very selective when it comes to sex. Rothschilds marry only Rothschilds. The Murdocks, the Bronfmans and Rothschilds want to increase illegitimacy in the lower classes because it is so destabilizing, just like flooding their neighborhoods with narcotics. "TRIAD" TO TAKE DOWN AGRICULTURE PRESERVE IN NAPA COUNTY.
 STINKY DEALS HIT COUNTY HARD.

Plans to forever alter 3,200 acres of land in Pope Valley (Napa County) into a "master planned community" of very high-end vineyard estates reveal a disaster in the making.

And there's a stench everywhere we turn. Not much different from on the waterfront. Oh, those smelly, fishy deals....  Or do we just have dumb bankers out there?

One of the stinkers: B of A is behind the deal. The seller of "Juliana Vineyards" is Reunion Industries, successor to the infamous Buttes Gas & Oil. Reunion is out of compliance with the terms of its financing from Bank of America and its heady 13% debenture as well (go to http://www.freeedgar.com, view filings, then select Form 10-K405 filed 3/30/00).

With losses of $1.5 million (and more each year), Reunion can't even come close to meeting its hurdle of $7.5 million/year minimum earnings before taxes (in this case a credit of $226,000) and interest (which is $3.4 million/yr).

When B of A booked the loan commitment for $40 million, they collected a $1million fee in Oct. 1998. They were lending at that time to a bankrupt concern and have a lien on all the Juliana Vineyards as of that date--all 3,200 acres remaining.

So, it looks like the "ex-Marines" heading B of A are landing again to attempt to dominate and sway the Planning Commission and Board of Supervisors where opposition groups plan to challenge the project to the bitter end.

Just as stinky....  Price Waterhouse hasn't even qualified their audit opinion with respect to Reunion! But then, perhaps it isn't such a surprise from a CPA firm until recently ruled by Don Dominic Tarantino. (We have a long history of fishy deals in this San Francisco family.)

Price Waterhouse has not questioned the ability of Reunion to survive as an ongoing concern. When CPA letters are not "qualified," the loan can be innocuously categorized as to risk/quality by the bank, thereby escaping scrutiny of regulators who otherwise carefully examine classified (poor quality) loan portfolios.

But then again, at PriceWaterhouse (now PriceWaterhouse Coopers) there have been recent shakeups with the revelation that 82% of all partners (more than 2,600 of them worldwide) are "in conflict of interest" holding securities in corporations they audit! Talk about stinky, fishy, waterfront stuff. Things are so bad there as ongoing Federal investigations reveal that one SEC enforcer said "there seems to be a culture problem here." (See http://www.sec.gov for early Y2K press release).

In fact if the numbers from Reunion's financial statements are put through the Altman Bankruptcy Model, the firm was in the "likely to fail within 12 months" range at the time the loan was made!

Why would Bank of America pick up this type of loan business? They have not been a lender to Reunion Industries in the past, or to Buttes except indirectly through Napa National Bank, an affiliate.

Could B of A also be the financiers behind Triad Development, Inc.? It would be nice to know, but once exposed to the local press, developers Fred Grimm and John Goodman, have failed to return calls.

B of A has had a long-standing association with "spooks" and mobs of every ethnic and non-ethnic persuasion. It doesn’t look like much changed despite the recent merger with NationsBank.

STINKY-SPOOKY POWER PLAYS

How many people recall that "spooks" Kermit Roosevelt and Miles Copeland worked for Gulf Oil which in turn had a subsidiary--Gulf Resources. Remember, it was Gulf Resources that was used as a conduit for the $100,000 CIA-related payment to the Watergate burglar crew in the good 'ole Dick Nixon years. Now that one was really stinky!

With Kermit Roosevelt hanging out at Gulf then, and moving thereafter to the Board of Buttes Gas & Oil of which Reunion Industries is a successor, is there some deeper reason, some compulsion on the part of the bank to keep this hemorrhaging firm in business?

Former Marine Col. Ollie North, in testimony before Congress in 1987 described the CIA and "secret government" practice of maintaining "off the shelf" companies to help conduit monies and goods. He also described his responsibilities, which included "working with the private sector to deliver arms to the Contras" in coordination with the CIA, then under the wing of the National Security Council. His cute little diversion account discovered in Switzerland was from one of those shelf businesses known as Lake Resources. (See Joseph Persico's "Casey", Rachel Ehrenfield's "Evil Money" and Miles Copeland's "The Gameplayer.")

Meanwhile, the then-local spook about the Bay Area, Kermit Roosevelt, maintained many "Buttes Resources." Resources, resources, resources.... Examine anything with resources in the name--even Brent Scowcroft did while on the Board of Pennzoil.

A former National Security Advisor, Scowcroft fended off a hostile take-over attempt of Pennzoil by Union Pacific Resources (all aptly described in documents filed with the SEC by Pennzoil). And who sits on the Board of Union Pacific Resources today? Why, Lynne Cheney, wife of Richard Cheney, George Bush's choice for Vice President!

The "resources" network has even more potential to be called off the shelf with this line-up of a former Secretary of Defense (who helped bring us Gulf War and Gulf War Syndrome) to whom the CIA would report if he's enshrined in the White House. Cheney's wife conveniently sits on the board of one of the more infamous resources of them all! (But mind you, Pennzoil still holds all those spicy corporate records Drew Lewis (George H.W. Bush's Bohemian Grove camp-mate) was trying to grab with the Pennzoil take-over. Remember: Pennzoil is in fact the old Zapata Oil founded by George H.W. Bush and the Leidtke brothers, whose father was chief counsel for Gulf Oil during all those Roosevelt-Copeland years of service). Heaven knows how many "shelf businesses" may rest within the Pennzoil fold. After all, George H.W. Bush was the big tuna of the CIA in 1976.

SO WHY DOES REUNION INDUSTRIES, (SUCCESSOR TO REUNION RESOURCES, SUCCESSOR TO BUTTES GAS & OIL AND ITS RESOURCES) STINK SO MUCH?

At this writing, the three biggest assets of Reunion Industries are (1) Juliana Vineyards up for grabs by Triad Development, Inc. (2) approximately $225 million in "tax-loss carry-forwards" and (3) a series of inactive (note, inactive, not closed, discontinued, or otherwise dissolved) subsidiaries.

These subsidiaries are found on pages 69-70 of the 10-K Annual Report filed by Reunion Industries 3/30/97--lots of spooky Delaware corporations. Many of them have yet other subsidiaries layered down. They rest, we think in reserve, in such places as Malaysia and Sharjah.

As $1.3 billion in aid is being dumped into Colombia, we are reminded of "Buttes Resources International, Buttes Resources Guatemala, Buttes Resources Nicaragua, Ocean Phoenix, Buttes Resources do Brazil, Progress Drilling International (a Panamanian corporation showing a mailing address of P.O. Box 77, Pope Valley). All of these are listed as inactive subsidiaries of Reunion Industries! With the sale, who's going to be minding that post office box in Pope Valley if Progress Drilling International is "popped off the shelf" as Ollie would say?

Why do the residents of Pope Valley and Napa County have to suffer the lunacy legacy of these "nuts?" Even the widow of Kermit Roosevelt said her late husband "didn't talk about that spook stuff." When interviewed, Kermit's son vaguely and disingenuously said "I think he once served in intelligence with the OSS during World War II in Sicily" (with the infamous Allan Dulles no less).

"Nuttiness" obviously runs in the family if Kermit's son missed the New York Times expose of his father last April 16. Give us a break--I mean 2 full pages and a front page header. Yep, your Dad was the one who failed to "stand down" thus bringing us "the Shah of Iran" and a new flood of heroin into the pipelines after 1953. Even wonder why heroin began to surface in a big way by 1954 in New York? The French Connection ...?

WHAT'S BANK OF AMERICA'S PROBLEM? 

Why can't B of A simply find some nice cattleman among its customer ranks to buy the land for its truly highest and best use? Take a loss on the loan as it rightfully should? Say, why not make a corporate gift to the County of Napa--open space for a park, no strings attached.

The Juliana properties are lovely range, studded with oak-covered hills. It's heaven on earth for cattle, all 3,200 acres.

For Pope Valley, development of any type presents an ecological nightmare -- from water problems, to hillside development and the attendant spoilages that result ... sedimentary runoff, extinguished wildlife habitats, the introduction of nitrogens to the water systems when all of those estates and vineyards are tended, and on and on and on.

WATCH OUT!  IT PROMISES TO BE A CONSUMER RIP-OFF! 

And what of any future owner of the properties? Juliana Vineyards hasn't returned a profit in its entire history of vineyard ownership. The county has already determined that because of the costs of financing land acquisitions, one has to have 160 acres of growing vines to break even. It is another reason parcels were set to this minimum. So why did Reunion Industries with a little help from developer Pacific Union carve themdown to 50 acres in size? This was at a time when vineyards were going for $35,000/acre. Recent sales: $106,000 - $150,000 per acre.

The above sales suggest that Reunion or Triad would need to "bundle up those lots" so their residents could afford to "farm them"--like have at least 400 acres of vines to possibly break-even? And check it out with facts. Recent sales in 1997, 1998 and 1999 by Reunion Industries were 520 acres to Hess Collection Winery, 420 acres to Mildara Blass (a division of Foster's Brewing from the land down under), and 260 acres to St. Supery.

Could these new residents ever break even when Juliana has been losing its shirt farming at one time more than 700 acres? And with the "glassy winged sharp-shooter" heading this way? The carrier of Pierce's Disease which is fatal to vines?

Is B of A behind a consumer rip-off? Who finances Triad Development, Inc? Who came up with this "stinky deal" that has been consistently rejected by Napa County government? What gives Triad Development, Inc. the "balls" to think they can buy the County into this one? A highly motivated lender?

Please note: There are judgments up the ka-zooooooh against Reunion Industries for millions upon millions of dollars. So why is B of A now sapping up and sucking up in asset spin-off deals?

Dear Ms. Edwards:

I am a free lance journalist who has written for various media over the past twenty-five years.  In all that time, I have never seen such an abuse of process and blatant fraud upon the taxpayers and the public as I have witnessed in the prosecutions of Carol Mardeusz in Marin and Sonoma Counties.

Mardeusz' daughter, Haleigh, was given to her natural father, Leo Magers, the very man who had been booked in Marin County for lewd and lascivious conduct with the child.  Marin and Sonoma Counties are working hand-in-glove to blackmail Carol Mardeusz into silence in the case of "America's Child", Polly Klaas.  Haleigh has not been allowed to see her mother, her sister, or any member of her maternal family for the past five years.  No one knows if this child is dead or alive and no child protective service or court has made any move to protect this child.  The only person who is working diligently to protect this child is her mother, Carol.

Is Carol Mardeusz  being persecuted and prosecuted solely because she is a key Brady witness in the Polly Klaas kidnapping and murder?.  In order to support the horrendous cover up in the Klaas case, Mardeusz MUST be jailed and discredited before Richard Allen Davis can be appointed an appeal lawyer for his death sentence.  I have checked with the Santa Clara County Court and I have found that the Davis appeal is on the fast track for appointment of an appeal lawyer.  That is the reason for the little "Nazi" trial conducted by "Judge" Verna Adams and District Attorney Paula Kamena's office.

Michael Mullins wanted an "added enhancement" to assure the death penalty for Richard Allen Davis in the Polly Klaas case.  He choose  "attempted lewd and lascivious act on a minor" over the more obvious "lying in wait".   Various judges who heard this case questioned the terminology "attempted" lewd and lascivious act on a minor and the elimination of  "lying in wait".   Twenty-three "Petaluma Witnesses", including Carol, Natalie and Haleigh Mardeusz, would have testified that TWO men were stalking young girls in the neighborhood a full two weeks before Polly Klaas was taken.  One man answered the description of Richard Allen Davis and the other man did not.  In the last two weeks of September 1993, Carol Mardeusz made police reports and alerted the schools that these two men were stalking young girls.  She supplied the license number of the vehicle Richard Allen Davis was driving to the Petaluma Police Department and yet,  Davis remained free for two months after he kidnapped Polly Klaas.

There was more than one individual involved in taking Polly.  This was a crime performed for money.  It well might have a been a case of mistaken identity.  Perhaps the victim was intended to be Carol Mardeusz's daughter, Natalie, a look-alike for Polly Klaas.

It was Natalie Mardeusz and her girlfriend, Diane Cucci  who were stalked by a man answering the description of Richard Allen Davis according to Petaluma Police Report #93-7113 dated September 16, 1993 and the police issued an all points bulletin for the man  and alerted the schools in the neighborhood.  This report, filed by Carol Mardeusz,  was not sent to the FBI by the Petaluma Police Department until October 21, 1993, three weeks AFTER the kidnapping of Polly Klaas.  Key witnesses, Natalie Mardeusz and Carol Mardeusz, were not interviewed by any investigator in the Klaas case until February 5, 1995 when investigator Mike Meese briefly interviewed mother and daughter.  They were never contacted by law enforcement again.  On February 5, 1995 Leo Magers also files a  falsified missing person report #95-1020 on Haleigh Magers-Mardeusz with the Petaluma Police Department.  This police report is used to place Haleigh "at risk", an action effectively placing the child under the control of Sonoma County courts.   These same courts conveniently employ Leo Magers's attorney, Catherine Conner, to represent "at risk" children in court, a direct conflict of interest depriving Haleigh of independent counsel.

The very next day, February 6, 1995, Leo Magers and his mother, Dr. Betty Dittbenner Magers, are arrested, fingerprinted and  booked in Marin County for child molestation of Haleigh Magers-Mardeusz.  Dr. Betty Magers immediately pays her long-time friend, former FBI agent Frank Connolly,  to give her and her son lie detector tests.  Both individuals allegedly pass the lie detector tests and Magers hand delivers the results to Marin County Assistant Prosecutor Paula Kamena.  Four days later Deputy District Attorney Kelly Vierira decides to not to prosecute the Magers.  The evidence of a recent internal examination of Haleigh is ordered destroyed by the prosecutor's office.

A ex parte hearing  on August 31, 1995 before Sonoma County Superior Court Judge Lloyd VonDerMeeden results in an order changing physical custody of Haleigh from mother, Carol, to the natural father, Leo Magers.  It is a secret court conducted like a star chamber with no notice to Carol Mardeusz.

On  September 3, 1995 an unsuspecting Carol Mardeusz delivered her traumatized child, Haleigh Mardeusz, to Leo Magers for a court ordered visitation.  The screaming child was ripped from the mother's arms by the Rohnert Park Police Department acting in concert with the Sonoma County Court System and handed over to Leo Magers, who only seven months earlier had been booked for her abuse is Marin County.  Haleigh is now completely under the control of Magers and his live-in girlfriend.

You must ask yourself the hard question, "Why has a loving mother and the entire maternal family been absolutely prohibited from seeing Haleigh Magers-Mardeusz"
for five years.  It is my opinion that if the child is still alive and were to be examined by an independent third party, the physical abuse she has suffered at the hands of her natural father would be painfully obvious.  The scars from the cigarette burns to the FRONT of  both of her legs would be apparent.  During a supervised visitation with her mother Haleigh cries and tells her mother and the visitation supervisor that "Daddy did it" (see picture of Haleigh's leg burns). Marin County prosecutors Paula Kamena and Kelly Vieira know full well that this man, who has total control over Haleigh, has abused this child and they are covering it up.  Why?  Read the  enclosed letter Ms. Kamena sent to me on March 7, 1997.  Click to read the letter. This letter was written by Ms. Kamena, who personally made the decision not to prosecute Leo Magers and Dr. Betty Magers after they had both been booked by the Marin prosecutor's office for lewd and lascivious acts with Haleigh.

In this package you will find proof that Leo Magers is a self-admitted cocaine distributor coupled with declarations from his former girlfriends that he is very abusive to women.  Ms. Vieira and Ms. Kamena, acting in concert with Judge Dufficy and "Judge" Verna Adams, have all worked overtime to make certain that Leo Magers is protected and Haleigh continues to be exposed to abuse.  The conduct of all of those involved in the Mardeusz case makes me wonder who are the benefactors of Leo Magers's cocaine distribution in Marin and Sonoma Counties.  Does Magers distribute cocaine for free every time or does he have a customer list?

I was just told that you have made recommendations in your completed report to "Judge" Adams that Carol Mardeusz be committed to a mental institution because she will not goose step in line with the government line of protecting the perpetrator and victimizing the defenseless victim.  I now doubt that reading this entire package of proof will have any effect on the pre-determined sentence dictated for Carol Mardeusz.  I question your expertise to judge who is mentally ill in this case and who is not.

 Perhaps you will have enough curiosity to at least read the best book written on the Polly Klaas case, "Who Killed Polly?" by the late Frank Spiering.  The author asks all of the right questions but they are asked in vain until and unless the associates of Richard Allen Davis are brought to justice.

I write this as 8-year-old Midsi Sanchez celebrates her freedom with her family in Vallejo.  Midsi liberated herself from her abuser and kidnapper.  Police throughout the bay area are hailing her as a hero.

It is apparent that Haleigh Magers-Mardeusz will also be forced to free herself from her captor because no one in Marin and Sonoma Counties will protect her.  One more child sacrificed to a system that protects the perpetrators.   Thank you for your time.
