Bush's War Against California: First Cut The Power, Then Cut Funding by Larry Chin © 3/2/01
The U.S. Census Bureau yesterday recommended that California's census data will not be adjusted with new figures for the year 2000. This move, which is expected to be heartily embraced by the Bush administration and Commerce Secretary Don Evans, will cost California hundreds of millions of dollars in federal funding for social programs, education and transportation.
The political impact is equally staggering: it will tip redistricting in the overwhelmingly Democratic state to favor the Republicans in future elections.
Take that, California.
Already staggering from an "energy crisis" that has been manufactured and manipulated by a consortium of Bush-affiliated Texas power companies, the state that rejected Bush at the polls faces a new round of Republican beatings designed to strip California Democrats of their political power, and maximize the suffering of the staunchest Democratic citizens---the
minorities, the urban and the poor.
Squash California. Destroy Democrats.
Census figures are crucial in allocating federal funding. A higher population figure merits a higher level of federal funding. Accurate data is key in determining the political landscape based on population trends. State and local electoral districting can be the make-or-break factor in elections.
Just as a "full, fair and accurate" vote count in the presidential election was thwarted at every turn using the most transparently criminal means, an accurate population count in California is being blocked by the GOP for the similarly spurious reasons.
In a statement worthy of Katherine Harris, the Census Bureau said that (despite the possibility that adjusted population figures would be more accurate) it will be unable to make a conclusive finding on the merits of an adjusted (and by many studies, a considerably larger) California population count by its federal reporting deadline of April 1, 2001.
Pleas from congressional Democrats to extend the deadline for an accurate count have been met with wicked silence. Nothing could bring Bush and the GOP more pleasure than the chance to gut a Democratic stronghold, and seize future elections.
The disenfranchisement continues
In yet another parallel to November, Bush and the GOP racists will garner political gain at the expense of minorities.
If accepted by Bush, the Census bureau's move will mean that hundreds of thousands of Californians will not be counted when the federal government allocates $200 billion in annual funds for states and cities. California's large ethnic population, which some experts put at 50%, will suffer the most from projected cuts in social programs. Urban and inner city populations will
be hit the hardest.
Towards eventual surrender
The Bush administration's war against California is proceeding according to plan.
A bogus power crisis has left the state at the mercy of greedy Texas power companies intent on gutting environmental laws, drilling offshore, and opening new power plants under the guise of "deregulation". California's once thriving economy has been derailed and its future business prospects have dimmed. Democratic opponents have been chopped off at the knees.
Now, with the stroke of a pen, come cuts in social programs and Republican political power over future elections.
Civil rights leaders are crying foul. California Democrats are calling on Bush to muster up some "compassion".
Fat lot of good it will do. Californians are prisoners of war. No mercy forthcoming.

Drugs, hate literature seized in couple's home.

CORBETT, Ore. (AP) -- A Clackamas County couple was arrested on drug-related charges as part of a continuing investigation into the activities of a white separatist group.
Fritz A. Springmeier, 45, also known as Victor E. Schoff, and his wife, Patricia Springmeier, 46, were charged Thursday with first-degree manufacture and distribution of a controlled substance and conspiracy to manufacture and distribute controlled substances.
They were held in the Clackamas County Jail on $10,500 bail each.
The FBI, the federal Bureau of Alcohol, Tobacco and Firearms and Clackamas County Sheriff's deputies searched the couple's home Thursday and seized marijuana-growing equipment, several weapons and white sepratist literature, said Angela Blanchard, a sheriff's department spokeswoman.
Fritz Springmeier writes books on the beliefs of the Christian Patriot Association, an ultra-right-wing group based in Boring, Blanchard said.
Police believe the Springmeiers are linked to at least one person arrested last month in Sandy.
Three people were arrested Feb. 9 at a rural Sandy home, where police seized military-style weapons and 50 marijuana plants. Police also found small amounts of ammonium nitrate and fuel oil and literature affiliated with the Army of God, a white supremacist group connected to the 1997 bombings of an abortion clinic and a gay nightclub in Atlanta.
Forest E. Bateman Junior, 29, is still being held at the Justice Center Jail in Portland on outstanding warrants for previous charges of assault and illegal possession of an AK-47 assault rifle. Two others, Anthony D. Huntington, 28, and Jennifer J. Williams, 27, were released.
Blanchard said investigators believe the Springmeiers helped Bateman grow and distribute marijuana. Bateman and Fritz Springmeier met at a Christian Patriot Association meeting several years ago, she said.

It is perhaps the most notorious crime in Irvine history. It involved a mob-like attempt on a top executive's life, a high-profile suicide, buried military-grade explosives and automatic weapons, germ warfare research and ties to international intelligence programs.
And the fact that much of the story happened in a tranquil Woodbridge neighborhood made it all the more bizarre. The Biofem story propelled Irvine into national headlines. And it happened one year ago this week.
On Feb. 28, 2000, someone approached Biofem CEO James Patrick Riley just after he had parked his car in front of the Spectrum Bank near the Biofem offices, and shot him in the face. Riley fell to the ground, and the gunman, described as a slightly built male or female clad in black, ran through a courtyard, arms flailing. Witnesses saw the shooter jump into a waiting van, which drove away.
The shooter is still eluding police. Sgt. Tom Little of the Irvine Police Department said this week that although authorities are still pursuing active leads, "it's not anything we can talk about."
Police, however, arrested the alleged getaway driver a mere 12 hours after the attack. His was the first arrest made, and so far, remains the last. They found Altadena businessman Dino D'Saachs, 56, based on a license plate number witnesses said they saw on the getaway van.
Police discovered the van awaiting a paint job at a Los Angeles auto shop; inside the van and in the D'Saachs home and businesses, police found evidence, including a manual titled "Silencers from the Home Workshop," and photos of the parking area with Riley's parking space marked with an X.
One investigator testified at an early hearing that a friend of D'Saachs had seen the photos about three months before the shooting, which indicates the photos had not been placed on D'Saachs' property shortly before or even after the shooting this, prosecutors say, is in line with their theory that the attack had been planned over the course of months.
Now, a year later, D'Saachs' trial on charges of conspiracy to commit murder is scheduled to start on March 19 at the central courthouse in Santa Ana. D'Saachs, a tax consultant and father of four daughters, has maintained his innocence from the beginning. Through his lawyer, Henry Salcido, D'Saachs said he was in the area that day, but had nothing to do with the shooting.
Shortly after the attack, it came out that D'Saachs was a longtime friend of Riley's business partner, Dr. Larry C. Ford, a scientist.
Three days after the shooting, for reasons still unclear, Ford committed suicide in an upstairs bedroom of his family's home. Though police had interviewed him after the attack on Riley, neighbors said the gentle-hearted father of three was no murderer. They were puzzled about why the devout Mormon would have killed himself.
The days following the suicide were a whirlwind.
As the particulars began to develop about Ford's possible links to military and international weapons programs, FBI and county hazardous material teams decided to sweep the Ford grounds at 19 Foxboro. Approximately 42 homes and about 250 residents within a 300-foot radius of the Ford home were evacuated and sent to an Irvine hotel so that authorities could recover toxins and weapons they believed to be buried around the house.
The area resembled a ghost town, but for the haz-mat vehicles and makeshift tents lining the streets. Driveways were eerily empty, and each house had to be checked, and then labeled with a red "cleared" sign. The excavation took three full days and about $200,000 to complete.
The week before, police had received a tip that hazardous materials were inside a car that had been impounded at city hall in connection with the case. Hazardous materials experts were summoned and robots were deployed. They found nothing. The situation at the Ford home, however, proved more dangerous.
Six suspicious plastic canisters were unearthed on the right side of the house, underneath a three-foot by three-foot concrete slab that had been poured years ago. X-rays of the six plastic tubes, which were about 5 1/2 feet long and 10 inches in diameter, showed the presence of weapons. There were military-grade C-4 blasting caps, along with assault rifles and thousands of rounds of ammunition. Inside the home, they found 21 boxes of belted ammunition usually used in machine guns, in addition to pistols, shotguns and hunting rifles.
Authorities also found 20 to 30 jars containing germs known to cause salmonella and cholera inside the home. Just what Ford had been doing with the materials is still unclear.
As other particulars continued to develop about the scientist's possible links to past military and South African biological weapons programs, FBI and county hazardous material teams continued to dig for what they believed were hazardous materials buried under or around the home. They never found any.
Though police referred to Ford as a "suspect" at first, they began to refer to him as the "mastermind" behind the attempt on his partner's life. According to search warrant affidavits released a month after the shooting, authorities believe Ford's involvement was predicated on "financial gains related to the business activities of Biofem," which is a pharmaceutical company, where researchers were working on a female contraceptive device designed to prevent contraction of the AIDS virus.
Authorities questioned Riley about the value of Biofem after the attack. Riley, according to the affidavits, told police he estimated the value of his half of the company to be about $2 million. He said he and Ford were in the process of starting up a new medical business based on a breakthrough in their research, and that the value of the new business would "far exceed" the value of Biofem. Riley also told police Ford called him at the hospital soon after D'Saachs had been arrested in connection with the shooting.
Riley told Ford police had phone records showing Ford had talked with D'Saachs the morning of the attack. Ford admitted the calls took place, but insisted they talked only about medication for D'Saachs, and assured Riley he knew nothing of a murder plot.
Deputy Prosecutor Ebrahim Baytieh, on the case from day one, said this week that the meat of the prosecution's theory has not changed. During D'Saachs' trial, he said he and Prosecutor Doug Woodsmall will elaborate on the theory.
And a year later, city and police officials are still calling the evacuation the most complex operation in Irvine history. Approximately 300 city, county and federal officials logged between 10,000 and 15,000 hours over the course of four days.
Six or so government agencies, including the county bomb squad, were mobilized. In a matter of hours, residents were whisked away, a perimeter was established and the neighborhood sealed off, and the digging for possibly hazardous materials began. It was also a lengthy endeavor uncharacteristic for police operations, which normally span over hours rather than days and weeks.
Though lauded for the smooth operation, the department has made some changes to its protocol.
Commander Vic Thies now teaches a class for other officers in other agencies about how to respond to "weapons of mass destruction" incidents.
"This could happen anywhere," said Thies. "People think weapons of mass destruction or bio agents are only found in high-rise office buildings in New York City or Tokyo subway systems. People don't think it can happen in their backyard, but it can, as we've seen, and it will."
Thies did have one suggestion about something that could have been handled differently.
"We saw an attitude of complacency by first responders when we were dealing with that car in the lot," said Thies, referring to the first time Haz-Mat teams were called out with robots.
"We changed that around real quick. People thought this would be a false alarm. I call it a 'fatalistic attitude of complacency.' It's just like the situation with an officer handling a silent burglary alarm. One out of 1,000 is true, where suspects are actually inside. And if you let your guard down that one time, that one will be the real one. We have to treat all potential scares as real, until they're proven otherwise."
As for the ongoing Biofem saga, there are still many questions. The image of Ford as a loving husband, as a caring father and humanist remains strong as authorities continue to dissect the events of last February and March.
One Foxboro resident, who asked that her name not be used, said the incident especially the three-day evacuation still comes up in discussions among neighbors.
"Oh yeah, we definitely remember it," she said. "I'd characterize the whole thing as distressing, but not necessarily traumatic. It goes to show you never know what people have, or what people do."
Most neighbors are still not talking about the incident that shocked them last March. The Ford home, by all accounts, has not been placed on the real estate market. Police believe Diane Ford, Dr. Ford's wife, is still living there.
Lt. Sam Allevato said last March that after days and days of investigation and uncovering mounds of information, authorities still had uncovered only the "tip of the iceberg."
Prosecutors say the rest of the story will come out during the D'Saachs trial, which will begin in 19 days.
The Hanssen-Ames Connection Uncovered

The American FBI veteran Robert Philip Hanssen, 56, charged Tuesday, Feb. 20 with spying for Moscow, and the convicted CIA super-mole Aldrich Ames have a great deal in common that the FBI director Louis Freeh did not reveal. As DEBKA-Net-Weekly’s intelligence sources disclose here for the first time, both were recruited to the KGB’s First Chief Directorate (foreign) by the same pair of legendary British super-spies, Kim Philby, who defected to Moscow in 1961, and George Blake who lives in Moscow to this day. Ames, convicted in 1994 to a life sentence without parole, was a senior counterintelligence officer in the CIA; Hanssen filled a similar function in the FBI. Both climbed high in their services, got away with betraying secrets and double spies for decades before they were caught; their careers similarly straddled the crossover period between the KGB and the post-Soviet SVR; and both caused devastating damage.
A key date in the FBI director’s disquisition on Tuesday was 1985, when Hanssen was said to have been recruited to the KGB. That was also the date cited for Ames’s recruitment in his CIA indictment. Freeh touched on the link cursorily: he said Hanssen came under surveillance after Ames’s discovery as a result of the effort to identify additional penetrations. This comes nowhere near to doing justice to the relationship as it was, but it does indicate the long duration of the Hanssen investigation.
DEBKA-Net-Weekly’s sources maintain in this world exclusive that it was carried on parallel to the inquiry against Ames. Hence the great wealth of detail on Hanssen’s career as far back as the eighties, as presented to the court in Alexandria, Virginia, on Tuesday. Moreover, there is no way he could have kept his identity dark from the Russians; they knew exactly whom they were running behind the codename of “Ramon” and were also aware of the inquiry. What no one knows now is if he will he emulate his boss Ames and stay mum about the secrets of his double life, and in particular, the system of penetrations of which he was a part. For Ames was indeed the top dog of a whole army of moles, who still burrow unidentified under Western intelligence. He attained this pinnacle of power as head of the covert “Cooperative CIA/FBI Program”, America’s key counterintelligence tool in the eighties for recruiting double agents. As Ames himself put it in 1994 after he was caught: “We were putting together a basic program of establishing the Soviets’ modus operandi… that later built into quite a large program.”
As a senior CIA officer, he handled the agency’s spies, double spies and moles in foreign services in the West and East Europe. They believed they served Washington, while being exploited for the KGB and for Ames’s second master, the Chinese MSS. Hanssen kept watch for the FBI on Russian government embassies and missions in Washington and at UN Headquarters in New York; he performed his assignments on behalf of that cooperative program as Ames’s clandestine operational arm inside the FBI. As such, he betrayed Soviet embassy staff who spied for the US. Two were later executed in Moscow. Hanssen was therefore one of Ames’s super-moles and his vital channel into the US defense establishment. When the American probe began closing in on Hanssen, Moscow threw out veiled messages to Washington.
The US businessman Edmund Pope, convicted as an American spy in April 2000, was pardoned by President Putin in December 2000. That same month, Sergei Lebedev, head of Russia’s foreign intelligence SVR remarked out of the blue that the notorious British Cold War spy George Blake was still working “for the good of Russia”. Blake, a member of British counterintelligence from 1941 to 1961, was sentenced to 42 years for spying for Russia. He broke out of prison and escaped to Moscow in 1966. Dredging up the name of this 77-year old relic of the Cambridge Ring certainly revived old, uneasy Cold War memories in Washington.
The Russians were warning the Americans indirectly: Hands off Hanssen; Ames is still holding his tongue and so will Hanssen. If you expose him, we have Blake to take the lid of a Pandora’ s Box that will hurt you and rekindle the old intelligence war. Moscow was spurred into action shortly after the US presidential election in November - for good reason. In September 1997, ex-president Bill Clinton called off the hunt for Ames’s moles, instructing CIA director George Tenet to draw a line against the past and the damage Ames had wrought US intelligence.
But then, George W. Bush, while still president-elect, was asked to decide whether to let the Hanssen inquiry take its full course. He called together a group made up of his father – not only a former president but also a former CIA director - Vice President Dick Cheney, national security adviser Condaleezza Rice, Attorney General John Ashcroft, FBI director Louis Freeh, CIA director George Tenet and James Baker. They decided to bring the Hanssen case to its conclusion, on the assumption that he was the tip of an iceberg and his arrest might loosen Ames’s tongue, making it possible to flush out at last the moles still thriving in the system. Hanssen’s arrest and trial and their publication were meticulously prepared, with the focus on cautious presentation of the Hanssen-Ames-Moscow link. For President George W. Bush, it is important to uncover the links above and below the two men in the hidden chain of double agents and moles that still infests America’s defense system, and finally bring light to the murky events that lent the Reagan-Bush presidential era the epithet of Decade of the Spy.

Let's limit tenure of Supreme Court justices

Having created a president by distorting its own previous judicial reasoning, the Supreme Court is heady with power.
The justices' latest outrage was to deny the right of the federal government to enforce the Americans with Disabilities Act by immunizing states from discrimination suits brought under the law. Congress, the court said, did not have the authority to intervene in the employment contracts of the sovereign states except in rare, strictly defined circumstances.
The high bench blithely dismissed a long record of mistreatment of the disabled by state and local government agencies as behavior well within ``rational'' budget-making priorities. The court held that the act interfered with an employer's freedom to force workers to use ``existing facilities.'' In other words, it's a costly nuisance to build wheelchair ramps or widen toilet doors.
Obviously, this decision was more about penny-pinching than helping the disabled stay in the job mainstream. It also continued the court's recent campaign to reduce congressional power over the rights of states.
In ruling for George W. Bush, the conservative majority of the court found that the GOP-controlled Florida Legislature outranked the Democratic-dominated Florida Supreme Court. But now that the court's preferred candidate is safely in the White House, the 5-4 majority has returned to its theme of upholding the superiority of state courts.
More than 100 years ago, Lord Acton astutely observed that while power tends to corrupt, ``absolute power corrupts absolutely.'' That's what's wrong with the Supreme Court today.
Its credibility has been strained by its presidential ruling. But instead of exercising the judicial restraint that conservatives always profess to admire, the Supreme Court majority has become unabashedly arrogant.
There are several theories on why this has happened:
That the conservatives are convinced their numbers soon will be reinforced by Bush appointees of a similar ideological ilk, after which they will have virtually unfettered freedom to defy Congress and any other rival institution.
The real problem here is the smugness born of lifetime tenure. Basically, no federal judge can be removed from office once confirmed, except for serious misconduct or crime.
Scalia and the others have abused the privilege. It is time we changed that.
Officials of the legislative and executive branches operate within an electoral system in which their performance is regularly evaluated. The Supreme Court and the lower federal courts should have limited terms, too. Voters should be allowed to approve or reject them, as is now the case with state courts. Or justices should be routinely retired after a specific period so that an incumbent president may appoint someone new.
Thomas Jefferson rightly worried that the Supreme Court would become dangerous some day. Congress should consider a constitutional amendment to end lifetime tenure. It would require ratification by three fourths of the states, a difficult but not impossible hurdle.
In a letter to a judge in 1821, Jefferson wrote,``The great object of my fear is the federal judiciary . . . that body, like gravity, ever-acting with noiseless foot and unalarming advances, gaining ground step by step.''

Judge gives impetus to Bank of New York stockholder case against board of directors.

A New York federal judge has ordered the chairman of the board of the Bank of New York, Thomas A. Renyi, to turn over his tax returns and personal telephone toll and credit card records to the attorneys for three stockholders who sued him and other members of BONY's board of directors in September 1999. On March 1, 2001, Judge Denny Chin told Renyi he had two weeks to turn over his records. The banker will also give his deposition in the next few weeks.
Previously, Chin denied the motion of the board members' lawyers to dismiss the suit and to delay the case until the bank's "Special Litigation Committee" reviewed it.
Money Laundering Alert says in its April edition that the stockholder derivative suit is "a ticking time bomb" for members of the boards of directors of financial institutions and businesses that encounter money laundering legal problems.
The suit says Renyi and the board members inadequately supervised the officers and operations of the bank on the movement of $7 billion of dubious Russian origin. The alleged dereliction of duty, it says, "brought disgrace to the bank,… exposed (it) to potential fines, judgments and forfeiture(s)… in the tens of billions of dollars" and "caused irreversible harm to the bank's name and reputation." It is the first lawsuit against the board of directors of a publicly traded company based on money laundering control deficiencies and consequential institutional damage. (MLA, Nov. 1999).
In February 2000, Lucy Edwards, BONY's former vice president of the Eastern European Division, and her husband, Peter Berlin, pleaded guilty in the same federal court to money laundering conspiracy linked to their facilitation of the movement of massive sums of Russian money through corporate accounts Berlin had opened at BONY. They are cooperating with the government and have not yet been sentenced.

Web site helps to find free or low-cost health care

A 55-year-old federal program providing free or affordable medicine and health care is under-used and under- publicized, according health care advocates.
"There are currently 687 facilities that provide free or low-cost medical care, but there is rarely any publicity to let the public know about this program," said Jim Surasak, a researcher with Financial Assistance Network or FAN, a nonprofit organization.
In addition, the FAN Web site provides links to dozens of pharmaceutical firms offering free prescription drugs. Many firms have long-standing free drug programs.
The Hill-Burton Act, which was passed by the U.S. Congress in 1946, has provided more than $35 billion in free or low cost care to qualified participants, according to the FAN Web site. At the time, the government agreed to subsidize the construction of hospitals and medical care facilities in exchange for health care providers offering some free care to the poor in the community.
FAN released a booklet, "Free and Low Cost Medical Care," which assists in locating participating facilities and drug firms, and in determining eligibility.
