SCIENTISTS FEAR NUCLEAR MELTDOWN ON SEABED

An uncontrolled chain reaction in the engine compartment of the stricken Russian nuclear submarine Kursk was "the worst case scenario" being contemplated by Russian experts yesterday. If that happened the fuel would heat up to 1800 to 2000C, enough to melt the engine compartment and outer casing, releasing molten fuel onto the seabed.

Mils Bohmer, a Russian nuclear physicist, said this would release fission products like plutonium, caesium and uranium into the fertile fishing grounds of the Barents sea. However, the true state of the reactors is not yet known.

"We were told that the first stage of shutting the reactors down had been completed, but there is no word on what happened after that," he said. "If the crew managed to shut them down completely then they should remain safe, but if not then the fuel elements may start to heat up and begin an uncontrolled chain reaction."

Mr Bohmer was speaking in Oslo, where he has been helping the Norwegian environmental group the Bellona Foundation in its efforts to get the derelict submarines of the Russian fleet made safe.

He said because there had been an explosion in the forward area it was not possible to know the effect on the crew in the engine compartment at the rear had been or how much time they may have had to act.

The reactor in the submarine was of a new design with a "natural" cooling system which works even if there is no electrical power, but it might not be effective if there was damage or the reactor had not been fully shut down.

William Peden, a Greenpeace disarmament campaigner, said that the automatic cooling system worked on convection and its efficiency would be badly affected because the stricken vessel was lying on its side.

"There is also concern because the explosion would have caused a breach in the hull part of the containment if the radioactivity begins to leak out," he said. "There is a real fear of a meltdown if the cooling system does work properly. To protect the area from serious radioactive pollution the Russians have no alternative but to raise the sub."

Mr Bohmer believed the Russians would want to raise the sub anyway because it was in relatively shallow water - 108 metres (353ft) - and, as a relatively new boat it contains military secrets the Russians would be keen to protect from other powers.

In one sense the sea is the best place for damaged nuclear equipment because of the dilution and cooling effect of vast quantities of sea water.

However, the Kursk has gone down in one of the most productive fisheries in the world, where Norwegians catch large quantities of cod, some of which is exported for English fish and chips.

The Russians have suffered nuclear accidents there before. However, the Komsomolets, which sunk in April 1989, rests in 1,850 metres (6,069ft) of water and although it is leaking slightly is not contaminating fishing grounds.

Yesterday the news from the area of the Kursk was good. Tests of water and air samples by the Norwegian Nuclear Protection Authority said five water samples and two air samples gathered through large filters on Tuesday showed no trace of abnormal radiation. The samples were gathered by Norwegian military vessels monitoring the site.

Dark Side of Rev. Moon: Drug Allies

Amid debates over the 115-year-old Pendleton Act and whether it covers fund- raising phone calls from the White House, a more sinister money-in-politics issue continues to go unnoticed: the vast political influence-buying operation of the Rev. Sun Myung Moon. The Clinton administration appears no more interested in where Moon's mysterious millions originate than was the Reagan-Bush administrations which benefited from Moon's largesse.

Our recent series, "Dark Side of Rev. Moon," documented how Moon's organization purchased influence through secret payments to key political figures, including former President George Bush and Religious Right leader Jerry Falwell. Moon also financed costly media outlets, such as The Washington Times. Moon has built this U.S. network even as he tells his followers that America is "Satan's harvest" and vows to subjugate the American people under a Korea-based theocracy.

The series also revealed that Moon's organization still engages in questionable financial practices. According to court records, the Moon organization has been laundering money and diverting funds to buy personal luxuries for Moon's family, including cocaine for Moon's son, Hyo Jin. The financial sleights-of-hand are reminiscent of offenses that led to Moon's conviction for tax evasion in 1982.

But since our series ran, more troubling facts about Moon's international political connections have been brought to our attention. Most disturbing, given Moon's free-spending ways, are his long-standing ties to ultra-rightists linked to Asian organized crime and to the Latin American drug trade. These associations -- and Moon's deepening business operations in South America -- underscore the need for the U.S. government to ascertain exactly how Moon is financing his U.S. political empire.

Moon's representatives refuse to detail publicly how they sustain their far-flung operations. But they angrily rebut recurring allegations about profiteering off illegal trafficking in weapons and drugs.

In a typical response to a gun-running question by the Argentine newspaper, Clarin, Moon's representative Ricardo DeSena responded, "I deny categorically these accusations and also the barbarities that are said about drugs and brainwashing. Our movement responds to the harmony of the races, nations and religions and proclaims that the family is the school of love." [Clarin, July 7, 1996]

But Moon's relationships with drug-tainted gangsters and corrupt right-wing politicians go back to the early days of his Unification Church in Asia. Moon's Korea-based church made its first important inroads in Japan in the early 1960s after gaining the support of Ryoichi Sasakawa, a leader of the Japanese yakuza crime syndicate who once hailed Italian dictator Benito Mussolini as "the perfect fascist." In Japan and Korea, the shadowy yakuza ran lucrative drug smuggling, gambling and prostitution rings.

The Sasakawa connection brought Moon both converts and clout because Sasakawa was a behind-the-scenes leader of Japan's ruling Liberal Democratic Party. On the international scene, Sasakawa helped found the Asian People's Anti-Communist League, which united the heroin-stained leadership of Nationalist China with rightists from Korea, Japan and elsewhere in Asia. In 1966, the Asian league evolved into the World Anti-Communist League with the inclusion of former Nazis from Europe, overt racialists from the United States and "death squad" operatives from Latin America, along with more traditional conservatives. Moon's followers played important roles in both organizations, which also maintained close ties to the CIA.

South American Drugs

Meanwhile, after World War II, South America was becoming a crossroads for Nazi fugitives and drug smugglers. Nazi war criminal Klaus Barbie, the so-called Butcher of Lyons, earned his living in Bolivia by selling his intelligence skills, while other ex-Nazis trafficked in narcotics. Often the lines crossed.

In those years, Auguste Ricord, a French war criminal who had collaborated with the Gestapo, set up shop in Paraguay. Ricord opened up French Connection heroin channels to American Mafia drug kingpin Santo Trafficante Jr., who controlled much of the heroin traffic into the United States. Columns by Jack Anderson identified, Ricord's accomplices as some of Paraguay's highest-ranking officers.

Another French Connection mobster, Christian David, relied on protection of Argentine authorities. While trafficking in heroin, David also "took on assignments for Argentina's terrorist organization, the Argentine Anti-Communist Alliance," Henrik Kruger wrote in The Great Heroin Coup. During President Nixon's "war on drugs," U.S. authorities smashed this famous French Connection and won extraditions of Ricord and David in 1972.

But by then, powerful drug lords had forged strong ties to South America's military leaders. Other Trafficante-connected groups, including right-wing anti-Castro Cubans in Miami, eagerly filled the drug void. Heroin from the Golden Triangle of Southeast Asia quickly replaced the French Connection heroin that had come mostly from the Middle East.

During this period, the CIA actively collaborated with right-wing army officers to oust left-leaning governments. And amid this swirl of anti-communism, Moon became active in South America. His first visit to Argentina was in 1965 when he blessed a square behind the presidential Pink House in Buenos Aires. He returned a decade later and began making high-level contacts in Argentina, Chile, Paraguay, Bolivia and Uruguay.

The far-right gained control of Argentina in 1976 with a Dirty War that "disappeared" tens of thousands of Argentines. Michael Levine, a star undercover agent of the Drug Enforcement Administration, was assigned to Buenos Aires and was struck how "death was very much a way of life in Argentina." A Nazi Reunion

In nearby coca-producing Bolivia, Nazi fugitive Klaus Barbie was working as a Bolivian intelligence officer and drawing up plans for a putsch that would add that central nation to the region's "stable axis" of right-wing regimes. Barbie contacted Argentine intelligence for help.

One of the first Argentine intelligence officers who arrived was Lt. Alfred Mario Mingolla. "Before our departure, we received a dossier on [Barbie]," Mingolla later told German investigative reporter Kai Hermann. "There it stated that he was of great use to Argentina because he played an important role in all of Latin America in the fight against communism. From the dossier, it was also clear that Altmann worked for the Americans." [For an English translation of Hermann's detailed account, see Covert Action Information Bulletin, Winter 1986]

As the Bolivian coup took shape, Bolivian Col. Luis Arce-Gomez, the cousin of cocaine kingpin Roberto Suarez, recruited neo-fascist terrorists such as Italian Stefano della Chiaie who had been working with the Argentine death squads. [See Cocaine Politics by Peter Dale Scott and Jonathan Marshall] Dr. Alfredo Candia, the Bolivian leader of the World Anti-Communist League, was coordinating the arrival of these paramilitary operatives from Argentina and Europe, Hermann reported. Meanwhile, Barbie started a secret lodge, called Thule. During meetings, he lectured to his followers underneath swastikas by candlelight.

While the CIA was encouraging this aggressive anti-communism on one level, Levine and his DEA field agents were moving against some of the conspirators for drug crimes. In May 1980, DEA in Miami seized 854 pounds of cocaine base and arrested two top Bolivian traffickers from the Roberto Suarez organization. But Levine saw the bust double-crossed, he suspected, for geo-political reasons.

One suspect, Jose Roberto Gasser "was almost immediately released from custody by the Miami U.S. attorney's office," Levine wrote. (Gasser was the son of Bolivian WACL associate Erwin Gasser, a leading figure in the upcoming coup.) The other defendant saw his bail lowered, letting him flee the United States. Levine worried about the fate of Bolivian officials who had helped DEA. [See Levine's Deep Cover]

On June 17, 1980, in nearly public planning for the coup, six of Bolivia's biggest traffickers met with the military conspirators to hammer out a financial deal for future protection of the cocaine trade. A La Paz businessman said the coming putsch should be called the "Cocaine Coup," a name that would stick. [Cocaine Politics]

Less than three weeks later, on July 6, DEA agent Levine met with a Bolivian trafficker named Hugo Hurtado-Candia. Over drinks, Hurtado outlined plans for the "new government" in which his niece Sonia Atala, a major cocaine supplier, will "be in a very strong position."

Later, an Argentine secret policeman told Levine that the CIA knew about the coup. "You North Americans amaze me. Don't you speak to your own people?" the officer wondered. "Do you think Bolivia's government -- or any government in South America -- can be changed without your government and mine being aware of it?"

When Levine asked why that affected the planned DEA investigation, the Argentine answered, "Because the same people he's naming as drug dealers are the people we are helping to rid Bolivia of leftists. ...Us. The Argentines ... working with your CIA." [Big White Lie]

The Cocaine Coup Cometh

On July 17, the Cocaine Coup began, spearheaded by Barbie and his neo-fascist goon squad dubbed Fiances of Death. "The masked thugs were not Bolivians; they spoke Spanish with German, French and Italian accents," Levine wrote. "Their uniforms bore neither national identification nor any markings, although many of them wore Nazi swastika armbands and insignias."

The slaughter was fierce. When the putschists stormed the national labor headquarters, they wounded labor leader Marcelo Quiroga, who had led the effort to indict former military dictator Hugo Banzer on drug and corruption charges. Quiroga "was dragged off to police headquarters to be the object of a game played by some of the torture experts imported from Argentina's dreaded Mechanic School of the Navy," Levine wrote.

"These experts applied their 'science' to Quiroga as a lesson to the Bolivians, who were a little backward in such matters. They kept Quiroga alive and suffering for hours. His castrated, tortured body was found days later in a place called 'The valley of the Moon' in southern La Paz." Women captives were gang-raped as part of their torture.

To Levine back in Buenos Aires, it was soon clear "that the primary goal of the revolution was the protection and control of Bolivia's cocaine industry. All major drug traffickers in prison were released, after which they joined the neo-Nazis in their rampage. Government buildings were invaded and trafficker files were either carried off or burned. Government employees were tortured and shot, the women tied and repeatedly raped by the paramilitaries and the freed traffickers."

The fascists celebrated with swastikas and shouts of "Heil Hitler!" Hermann reported. Col. Arce-Gomez, a central-casting image of a bemedaled, pot-bellied Latin dictator, grabbed broad powers as Interior Minister. Gen. Luis Garcia Meza was installed as Bolivia's new president.

Moon & the Putschists

Among the first well-wishers arriving in La Paz to congratulate the new government was Moon's top lieutenant, Bo Hi Pak. The Moon organization published a photo of Pak meeting with Gen. Garcia Meza. After the visit to the mountainous capital, Pak declared, "I have erected a throne for Father Moon in the world's highest city."

According to later Bolivian government and newspaper reports, a Moon representative invested about $4 million in preparations for the coup. Bolivia's WACL representatives also played key roles, and CAUSA, one of Moon's anti-communist organizations, listed as members nearly all the leading Bolivian coup-makers. [CAIB, Winter 1986]

After the coup, Arce-Gomez went into partnership with big narco-traffickers, including Trafficante's Cuban-American smugglers. Klaus Barbie and his neo-fascists got a new assignment: protecting Bolivia's major cocaine barons and transporting drugs to the border. [Cocaine Politics]

"The paramilitary units -- conceived by Barbie as a new type of SS -- sold themselves to the cocaine barons," concluded Hermann. "The attraction of fast money in the cocaine trade was stronger than the idea of a national socialist revolution in Latin America."

According to Levine, Arce-Gomez boasted to one top trafficker: "We will flood America's borders with cocaine." It was boast that the coup-makers backed up.

"Bolivia soon became the principal supplier of cocaine base to the then fledgling Colombian cartels, making themselves the main suppliers of cocaine to the United States," Levine said. "And it could not have been done without the tacit help of DEA and the active, covert help of the CIA."

On Dec. 16, 1980, Cuban-American intelligence operative Ricardo Morales told a Florida prosecutor that he had become an informer in Operation Tick-Talks, a Miami-based investigation that implicated Frank Castro and other Bay of Pigs veterans in a conspiracy to import cocaine from the new military rulers of Bolivia. [Cocaine Politics]

Years later, Medellin cartel money-launderer Ramon Milian Rodriguez testified before Senate hearings chaired by Sen. John Kerry, D-Mass. Milian Rodriguez stated that in the early days of the cartel, "Bolivia was much more significant than the other countries." [April 6, 1988]

As the drug lords consolidated their power in Bolivia, the Moon organization expanded its presence, too. Hermann reported that in early 1981, war criminal Barbie and Moon leader Thomas Ward were often seen together in apparent prayer. Mingolla, the Argentine intelligence officer, described Ward as his CIA paymaster, with the $1,500 monthly salary coming from the CAUSA office of Ward's representative. [CAIB, Winter 1986]

On May 31, 1981, Moon representatives sponsored a CAUSA reception at the Sheraton Hotel's Hall of Freedom in La Paz. Bo Hi Pak and Garcia Meza led a prayer for President Reagan's recovery from an assassination attempt. In his speech, Bo Hi Pak declared, "God had chosen the Bolivian people in the heart of South America as the ones to conquer communism." According to a later Bolivian intelligence report, the Moon organization sought to recruit an "armed church" of Bolivians, with about 7,000 Bolivians receiving some paramilitary training.

Cocaine Stresses

But by late 1981, the obvious cocaine taint was straining U.S.-Bolivian relations. "The Moon sect disappeared overnight from Bolivia as clandestinely as they had arrived," Hermann reported. Only Ward and a couple of others stayed on with the Bolivian information agency as it worked on a transition back to civilian rule.

According to Hermann's account, Mingolla met Ward in the cafeteria Fontana of La Paz's Hotel Plaza in March 1982. Ward was discouraged about the Bolivian operation. "The whole affair with Altmann [Barbie], with the whole fascism and Nazism bit, that was a dead-end street," Ward complained. "It was stupid having Moon and CAUSA here." [CAIB, Winter 1986] Ward could not be reached for comment about this article.

The Cocaine Coup leaders soon found themselves on the run. Interior Minister Arce-Gomez was eventually extradited to Miami and is serving a 30-year sentence for drug trafficking. Roberto Suarez got a 15-year prison sentence. Gen. Garcia Meza is a fugitive from a 30-year sentence imposed on him in Bolivia for abuse of power, corruption and murder. Barbie was returned to France to face a life sentence for war crimes. He died in 1992.

But Moon's organization paid little price for the Cocaine Coup. Funding U.S. conservative political conferences and founding the ultra-conservative Washington Times in 1982, Moon ingratiated himself to President Reagan and other leading Republicans. Moon also continued to build a political-economic base in South America.

In 1984, The New York Times called Moon's church "one of the largest foreign investors" in Uruguay, having invested some $70 million in the three preceding years. Investments included Uruguay's third largest bank, the Banco de Credito; the Hotel Victoria Plaza in Montevideo; and the newspaper, Ultimas Noticias. Moon's venture were aided by generous tax breaks from Uruguay's military government. "Church officials said Uruguay was especially attractive because of liberal laws that allow easy repatriation of profits abroad," the Times reported. [NYT, 2-16-84]

Supporting the Nicaraguan contra rebels, Moon's organization developed close ties, too, with the powerful Honduran military which gave the contras base camps along the Nicaraguan border. Again, Moon's representatives were in contact with officers suspected of supporting the shipment of cocaine into the United States. Anti-Castro Cubans linked to the Miami drug networks also appeared on the scene to advance the anti-communist cause as did intelligence officers from the Argentine military.

The Honduran Connection

Kerry's Senate report concluded that Honduras became an important way station for cocaine shipments heading north. "Elements of the Honduran military were involved ... in the protection of drug traffickers from 1980 on," the report stated. "These activities were reported to appropriate U.S. government officials throughout the period. Instead of moving decisively to close down the drug trafficking by stepping up the DEA presence in the country and using the foreign assistance the United States was extending to the Hondurans as a lever, the United States closed the DEA office in Tegucigalpa and appears to have ignored the issue." In the mid-1980s, when journalists and congressional investigators began probing the evidence of contra-connected drug trafficking, they encountered harsh attacks from Moon's Washington Times. An Associated Press story that I co-wrote with Brian Barger was denounced on the Times' front page as a "political ploy." [April 11, 1986]

The Times attacked Kerry's investigators first for wasting money [Aug. 13, 1986] and then with obstructing justice [Jan. 21, 1987]. Now, with a clearer picture of Moon's historic ties to drug-tainted officials in South America, the harassment of these investigations takes on a different appearance, of possible self-protection. [See our "Dark Side of Rev. Moon" series for more details.]

More recently, Moon has shifted his base of operation to a luxurious estate in Uruguay and continued to expand his South American holdings. He has invested heavily in the Argentine province of Corrientes, a border area near Paraguay that is known as a major smuggling center.

In a sermon to his followers on Jan. 2, 1996, Moon announced plans to begin building small airstrips in remote areas of South America as well as bases for submarines to evade Coast Guard patrols. Saying the airfield project would be for tourism, he added that "in the near future, we will have many small airports throughout the world." The submarines, he said, were needed because "there are so many restrictions due to national boundaries worldwide."

With his history and prominence, Moon and his organization would seem a natural attraction for U.S. government scrutiny. But Moon may have purchased insurance against any intrusive investigation by buying so many powerful American politicians that Washington's power centers can no more afford the scrutiny than he can.

activist has made her point. 
No protests at encampment

For years the grandest, most elaborate summer party in Sonoma County -- perhaps in all the world -- was the one where protestors shouted "Shame! Shame! Shame!" to guests arriving at the front gate.
 
The two-week bash, the Bohemian Grove Encampment, is getting under way this weekend in a splendid and private redwood retreat in Monte Rio. But the demonstrators are staying home.
 
Mary Moore, the woman from nearby Camp Meeker who organized yearly protests outside the grove, says she believes as firmly as ever that the present and past presidents and cabinet secretaries, industrialists and other powerful men who come to the male-only encampment bear responsibility for many of the ills of the world.
 
"More and more power is in fewer and fewer hands," said Moore. Over the past 20 years, she and other activists have gathered outside the Bohemian Grove in July to chide the arriving revelers for promoting or profiting from Central American wars, environmental degradation, apartheid, the plundering and bullying of the Third World, nuclear weapons proliferation, homelessness and myriad forms of social injustice.
 
But Moore turned 65 Friday, the same day that dozens of private jets whisked Bohemian Grove guests into the Sonoma County Airport. She said it's too much to continue organizing the mid-summer protest against what she sees as capitalist exploitation that benefits a wealthy few and victimizes many.
 
Besides, she said, "I personally feel the points have been made."
 
The grand camp-out, sponsored by the Bohemian Club of San Francisco, dates back to 1878. The people who put it on say protesters and the press exaggerate when they portray the Encampment as an opportunity for the rich and powerful to hatch plots and partnerships.
 
"You come here to relax and enjoy the camaraderie of friends in a beautiful setting," said Stephen DePetro, manager of the sponsoring Bohemian Club of San Francisco. "You don't come here to do business."
 
The motto of the Bohemian Grove -- "Weaving Spiders Come Not Here" -- officially discourages talk of business or politics. DePetro said the approximately 2,000 men who travel to Monte Rio from across the nation and overseas come to unwind and take advantage of programs that focus on nature, drama, literature and art.
 
The Bohemian Club was created by four newspapermen for the purpose of engendering the arts in San Francisco, which in the late 19th century was, compared to New York, an uncultured outpost. Club officials say that ever since the first Encampment was held 122 years ago as a farewell party for a departing member, its function as a social and cultural retreat has not changed.
 
Major attractions each year include elaborate stage plays, lakeside talks, musical performances, drink and golf.
 
On Friday, several dozen men from the Grove appeared at the Northwoods Golf Course on River Road, just inland from Monte Rio.
 
"Probably about 40 guys play each day," said the course's PGA pro, Don Kite.
 
"We know them now," he said. "It's pretty much the same guys who keep coming back every year."
 
Kite said the players include some celebrities, rock stars and big-name political or business leaders. "We never know which dignitary is going to be in which group," he said.
 
Over the years, the more prominent guests at the Bohemian Grove have included nearly every Republican president and some Democrats. George Bush, Ronald Reagan, Gerald Ford and Richard Nixon all have attended.
 
Other big names in recent years have included Clint Eastwood, former Cabinet members Henry Kissinger, George Schultz and Caspar Weinberger, and industrialists Stephen David Bechtel, Leonard Firestone and David Rockefeller.
 
The Bohemian Club never publicizes the names of guests, many of whom arrive at the Sonoma County Airport aboard private jets and twin-propeller planes.
 
Airport tower chief Dayle Buschkotter said Friday several dozen corporate aircraft -- Citations, Learjets, Falcon, Beechjets, Gulfstreams -- delivered Bohemian Grove guests Friday.
 
"It's been steady," she said of the arrivals and departures of sleek, privately owned and high-priced aircraft. "It provides eye candy for all of us watching from the tower."
 
In some previous years, demonstrators greeted new arrivals at the airport, holding up signs and shouting. Typically the demonstrators gathered at the Grove's gate, sometimes under the supervision of sheriff's deputies.
 
It's been several years since the last Bohemian Grove protest. Moore said from home Friday she feels that she and the others who demonstrated have done their work, alerting the public about the dangers of allowing too much power to fall into the hands of a fairly small group of men.
 
She said the cause has widened now, as witnessed by street protests against the World Trade Organization.
 
"Twenty years ago, they weren't talking about corporate power, not the way they are now," she said.
 
Only the men inside the Bohemian Grove know for sure what they're talking about in the camps and beneath the redwoods. Club Manager DePetro said business and politics are just the sorts of things the club members and their guests are coming to Monte Rio to get away from.

Dear Ms. Edwards:

I am a free lance journalist who has written for various media over the past twenty-five years.  In all that time, I have never seen such an abuse of process and blatant fraud upon the taxpayers and the public as I have witnessed in the prosecutions of Carol Mardeusz in Marin and Sonoma Counties.

Mardeusz' daughter, Haleigh, was given to her natural father, Leo Magers, the very man who had been booked in Marin County for lewd and lascivious conduct with the child.  Marin and Sonoma Counties are working hand-in-glove to blackmail Carol Mardeusz into silence in the case of "America's Child", Polly Klaas.  Haleigh has not been allowed to see her mother, her sister, or any member of her maternal family for the past five years.  No one knows if this child is dead or alive and no child protective service or court has made any move to protect this child.  The only person who is working diligently to protect this child is her mother, Carol.

Is Carol Mardeusz  being persecuted and prosecuted solely because she is a key Brady witness in the Polly Klaas kidnapping and murder?.  In order to support the horrendous cover up in the Klaas case, Mardeusz MUST be jailed and discredited before Richard Allen Davis can be appointed an appeal lawyer for his death sentence.  I have checked with the Santa Clara County Court and I have found that the Davis appeal is on the fast track for appointment of an appeal lawyer.  That is the reason for the little "Nazi" trial conducted by "Judge" Verna Adams and District Attorney Paula Kamena's office.

Sonoma County District Attorney J. Michael Mullins wanted an "added enhancement" to assure the death penalty for Richard Allen Davis in the Polly Klaas case.  He choose  "attempted lewd and lascivious act on a minor" over the more obvious "lying in wait".   Various judges who heard this case questioned the terminology "attempted" lewd and lascivious act on a minor and the elimination of  "lying in wait".   Twenty-three "Petaluma Witnesses", including Carol, Natalie and Haleigh Mardeusz, would have testified that TWO men were stalking young girls in the neighborhood a full two weeks before Polly Klaas was taken.  One man answered the description of Richard Allen Davis and the other man did not.  In the last two weeks of September 1993, Carol Mardeusz made police reports and alerted the schools that these two men were stalking young girls.  She supplied the license number of the vehicle Richard Allen Davis was driving to the Petaluma Police Department and yet,  Davis remained free for two months after he kidnapped Polly Klaas.

There was more than one individual involved in taking Polly.  This was a crime performed for money.  It well might have a been a case of mistaken identity.  Perhaps the victim was intended to be Carol Mardeusz's daughter, Natalie, a look-alike for Polly Klaas.

It was Natalie Mardeusz and her girlfriend, Diane Cucci  who were stalked by a man answering the description of Richard Allen Davis according to Petaluma Police Report #93-7113 dated September 16, 1993 and the police issued an all points bulletin for the man  and alerted the schools in the neighborhood.  This report, filed by Carol Mardeusz,  was not sent to the FBI by the Petaluma Police Department until October 21, 1993, three weeks AFTER the kidnapping of Polly Klaas.  Key witnesses, Natalie Mardeusz and Carol Mardeusz, were not interviewed by any investigator in the Klaas case until February 5, 1995 when investigator Mike Meese briefly interviewed mother and daughter.  They were never contacted by law enforcement again.  On February 5, 1995 Leo Magers also files a  falsified missing person report #95-1020 on Haleigh Magers-Mardeusz with the Petaluma Police Department.  This police report is used to place Haleigh "at risk", an action effectively placing the child under the control of Sonoma County courts.   These same courts conveniently employ Leo Magers's attorney, Catherine Conner, to represent "at risk" children in court, a direct conflict of interest depriving Haleigh of independent counsel.

The very next day, February 6, 1995, Leo Magers and his mother, Dr. Betty Dittbenner Magers, are arrested, fingerprinted and  booked in Marin County for child molestation of Haleigh Magers-Mardeusz.  Dr. Betty Magers immediately pays her long-time friend, former FBI agent Frank Connolly,  to give her and her son lie detector tests.  Both individuals allegedly pass the lie detector tests and Magers hand delivers the results to Marin County Assistant Prosecutor Paula Kamena.  Four days later Deputy District Attorney Kelly Vierira decides to not to prosecute the Magers.  The evidence of a recent internal examination of Haleigh is ordered destroyed by the prosecutor's office.

A ex parte hearing  on August 31, 1995 before Sonoma County Superior Court Judge Lloyd VonDerMeeden results in an order changing physical custody of Haleigh from mother, Carol, to the natural father, Leo Magers.  It is a secret court conducted like a star chamber with no notice to Carol Mardeusz.

On  September 3, 1995 an unsuspecting Carol Mardeusz delivered her traumatized child, Haleigh Mardeusz, to Leo Magers for a court ordered visitation.  The screaming child was ripped from the mother's arms by the Rohnert Park Police Department acting in concert with the Sonoma County Court System and handed over to Leo Magers, who only seven months earlier had been booked for her abuse is Marin County.  Haleigh is now completely under the control of Magers and his live-in girlfriend.

You must ask yourself the hard question, "Why has a loving mother and the entire maternal family been absolutely prohibited from seeing Haleigh Magers-Mardeusz"
for five years.  It is my opinion that if the child is still alive and were to be examined by an independent third party, the physical abuse she has suffered at the hands of her natural father would be painfully obvious.  The scars from the cigarette burns to the FRONT of  both of her legs would be apparent.  During a supervised visitation with her mother Haleigh cries and tells her mother and the visitation supervisor that "Daddy did it" (see picture of Haleigh's leg burns). Marin County prosecutors Paula Kamena and Kelly Vieira know full well that this man, who has total control over Haleigh, has abused this child and they are covering it up.  Why?  Read the  enclosed letter Ms. Kamena sent to me on March 7, 1997.  Click to read the letter. This letter was written by Ms. Kamena, who personally made the decision not to prosecute Leo Magers and Dr. Betty Magers after they had both been booked by the Marin prosecutor's office for lewd and lascivious acts with Haleigh.

In this package you will find proof that Leo Magers is a self-admitted cocaine distributor coupled with declarations from his former girlfriends that he is very abusive to women.  Ms. Vieira and Ms. Kamena, acting in concert with Judge Dufficy and "Judge" Verna Adams, have all worked overtime to make certain that Leo Magers is protected and Haleigh continues to be exposed to abuse.  The conduct of all of those involved in the Mardeusz case makes me wonder who are the benefactors of Leo Magers's cocaine distribution in Marin and Sonoma Counties.  Does Magers distribute cocaine for free every time or does he have a customer list?

I was just told that you have made recommendations in your completed report to "Judge" Adams that Carol Mardeusz be committed to a mental institution because she will not goose step in line with the government line of protecting the perpetrator and victimizing the defenseless victim.  I now doubt that reading this entire package of proof will have any effect on the pre-determined sentence dictated for Carol Mardeusz.  I question your expertise to judge who is mentally ill in this case and who is not.

 Perhaps you will have enough curiosity to at least read the best book written on the Polly Klaas case, "Who Killed Polly?" by the late Frank Spiering.  The author asks all of the right questions but they are asked in vain until and unless the associates of Richard Allen Davis are brought to justice.

I write this as 8-year-old Midsi Sanchez celebrates her freedom with her family in Vallejo.  Midsi liberated herself from her abuser and kidnapper.  Police throughout the bay area are hailing her as a hero.

It is apparent that Haleigh Magers-Mardeusz will also be forced to free herself from her captor because no one in Marin and Sonoma Counties will protect her.  One more child sacrificed to a system that protects the perpetrators.   Thank you for your time.

Eight-year-old Midsi Sanchez saw her break when the kidnapper left her in his car for a moment to panhandle for gas money.

The Vallejo girl went right for the man's keys, unlocked a chain he had wrapped around her ankle -- and ran.

She flagged down a passing truck driver, screaming ``I've been kidnapped,'' and within minutes of her daring escape, the youngster was under the protection of police in Santa Clara, some 70 miles from her Vallejo home.

Not long after that, she was eating McDonald's hamburgers and on the phone with her mom.

Late Saturday night, police tracked down Curtis Dean Anderson, 39, a San Jose resident with previous convictions for kidnapping and weapons violations, and took him into custody. Anderson once lived in Vallejo, but has no known connections to the girl.

Investigators believe the feisty 4-footer was abducted by a complete stranger Thursday just one block away from her family's home in Vallejo as she walked home from school. Then, after sleeping two nights in the front seat of a car, she managed to escape Saturday.

``She had all the right instincts and it probably saved her life,'' Santa Clara police Sgt. Anton Morec said Saturday. ``She's bright, articulate, you might even say a bit precocious,'' he added.

Susanna Velasco, who spoke with her daughter about 10 minutes mid-afternoon Saturday, told reporters that Midsi didn't seem scared and didn't sob. In a soft voice, the girl told her mother she missed her and wanted to come home.

``She is a hero,'' said Velasco, 30. ``She got away. She outsmarted him. I'm very proud of her.''

Velasco wasn't as good at holding back tears.

Saturday night, more than 100 well-wishers gathered around the front of Midsi's home, awaiting her arrival. Their mood was giddy, and adding to the festive atmosphere were balloons strung across trees and piñatas hanging from the rafters in the garage.

In a picture window in front of the house, a missing-child poster was replaced by a portrait of Midsi. Strung above the picture were banners reading: ``Welcome Back'' and ``Feliz Cumpleaños.''

As Midsi arrived home later Saturday night, the crowd outside roared. Brilliant TV camera lights shone on the path to the door. Midsi appeared scared as she was carried into the house in her father's arms. Once inside, he put her down and relatives and friends took turns hugging her. At that point, Midsi began to cry and she called out for her parents.

Meanwhile, the crowd outside serenaded her with rounds of ``Happy Birthday to You'' and ``Las Mañanitas,'' a traditional Mexican birthday song. Midsi's birthday was Aug. 3, and she had chosen Saturday to celebrate it.

At one point, Midsi's father brought her to the picture window, prompting more cheers from the crowd outside. Midsi cried, but the crowd broke out in song again and Midsi stopped crying and smiled. Her father beamed -- in stark contrast his demeanor earlier in the day, when he could barely lift his head.

The story of Midsi's alleged kidnapping began when the last school bell rang Thursday at 3:05 p.m. at Highland Elementary School in Vallejo. The girl, who was supposed to walk home with her older brother, wandered ahead of him.

As it now appears, investigators said, the kidnapper pulled up alongside her, picked her up, and then carried her to his car. Little is known about where exactly they drove or what they did.

But sometime Friday night, Anderson allegedly pulled up into the Santa Clara parking lot of America Networking, a business where he worked until sometime five to nine months ago. A company manager there told police he had just stopped showing up.

Police said the pair slept in the front seats of the car. The back was too crammed with garbage, clothes and other junk, the girl told police. She said he abandoned her at least a couple of times Friday night to talk with former co-workers inside the Laurelwood Road business.

But every time he left, she told police, he anchored her to the car by wrapping a chain around her right ankle and locking it to the underside of the seat.

The girl's chance came about 11 a.m. Saturday. Her abductor had gotten out of the car and walked several yards away to ask a group of people for gas money and the use of their cellular phone, police said.

He made one mistake: He left behind his ring of keys. Without hesitating, the girl grabbed the keys, found the right one and unlocked the chain that bound her to the car.

She threw open the door and ran into the middle of the nearest street. ``I've been kidnapped,'' the girl yelled to a passing delivery person before hopping up into his vehicle.

Police said the girl told the stranger her name and asked him to call for help. Vallejo police authorities believe Anderson started racing after the girl, and only turned back after seeing how close he was to being caught.

Police said he hopped into his car and took off again. Morec said Midsi was in police custody and on her way back to Vallejo about 3 p.m. Saturday, but was first headed to a hospital to be examined for any injuries.

Back at the family's home, dozens of friends and relatives gathered to celebrate the girl's return.

Earlier in the day, before Midsi's escape, celebration was far from their minds. The closest family members had gathered tearfully, knelt before a tabletop of candles and religious symbols and prayed the rosary.

Family in crisis

Some told stories. Fourteen-year-old Monica Velasco said every Saturday morning, her sister would pop out of bed and drag her pink Barbie sleeping bag to the living room couch where she would tune into Saturday morning cartoons.

Other times, she'd pop in a Spice Girls or Selena CD and watch herself dance and sing in the reflection of the stereo. But on this weekend morning, no one knew what the 8-year-old was doing. Where she was. Whom she was with. Or even if she was alive.

And instead of trying to drag her little girl away from the tube, Velasco faced camera crews and pleaded for her return.

It was just before noon when police began arriving at their house and whisked away Midsi's parents without saying a word. They wrapped yellow police tape around the house -- something the rest of the family thought was a sign that Midsi was dead.

The family broke down in tears. The girl's grandmother cried hysterically. A pregnant aunt held onto her protruding stomach as she wailed and prayed in Spanish. Relatives started yelling at each other. Monica began to hyperventilate. The crying was uncontrollable for more than 15 minutes. Then the phone rang.

It was Midsi's mom. She said nothing about the lost girl, but sounded calm and said she needed to speak to Monica. Final word didn't come for about an hour. But when it did, relatives raised their hands toward the sky in relief.

Residents, still grappling with the mysterious Dec. 9 disappearance of another Vallejo child, 7-year-old Xiana Fairchild, were happy about Midsi's return.

``What a gutsy little girl,'' said Bonnie Massenkoff. ``I would think a kid would be so frozen with fear they wouldn't know what to do.''

Child kidnapping by a stranger is a rare crime, according to statistics from the state Department of Justice. In 1997 in Santa Clara County, there was one child kidnapping by stranger, 233 child kidnappings by family members and 341 of unknown circumstances.

Vallejo police said they plan to help arrange counseling for Midsi. ``I just wanted to say how relieved we are to have her back,'' said Vallejo Mayor Anthony J. Intintoli.

``But we can't forget the second child this year and that we have another case outstanding and that tempers our joy. But we are immensely relieved -- very happy.''

CAROL MARDEUSZ FACES PRISON ON WEDNESDAY IN MARIN COURT.

The jury in the Carol Mardeusz case found her guilty as charged.

To get that verdict, Judge Verna Adams made certain that any of the evidence which would show that Carol is innocent was ordered to be kept from the jury.  The judges' instruction to the jury included that the jurors were not to consider the punishment when considering guilt or innocence. Nor were they to question the law, as the judge gave it to them. The jurors were not told of their absolute power to ignore the judge and the law, and to decide the case on its merits and their own consciences. Their questions to the judge went unanswered, or they were told they were "not to inquire" in the matters they questioned.

Given the kangaroo court nature of this set-up, the jury found Carol guilty of the narrow charges against her. She was not allowed to introduce exculpatory evidence. The jurors were duped by the lies of the DA and the unconscionable rulings of the judge.

If you've been following the case, you already know that this mom is innocent,  and that her daughter continues to be sacrificed by an uncaring, corrupt system, for reasons we can only guess at. Prosecuting a loving mom for trying to protect her child makes no sense, even if the mom were guilty as charged. Carol Mardeusz is NOT guilty as charged, or in any other manner. The system is guilty for protecting a child molester and a corrupt attorney, while it persecutes the innocent mom and betrays its responsibility to protect the child.

Carol's sentencing is scheduled for Wednesday, Aug 16, 9:00 a.m. in Judge Verna Adam's court. The probation department has been rushed in their evaluation, and it appears that the political "fix" is ongoing. The system wants this innocent woman in jail, and I expect that no matter how favorable the probation report, Adams will sentence Carol to enough time that she will be in jail during the Richard Alan Davis trial, for which she is a Brady witness. Carol's testimony could damage the official line that Davis acted
alone.

I've been following this case for about 2 years, and I now believe it very likely that much of her persecution at the hands of the bureaucracy has been to protect those whose careers depend upon their being able to continue to promote their claim that Richard Alan Davis acted alone in kidnapping and murdering Polly Klaas. Carol's testimony could cast doubt on the official theory, but not if she's in jail, discredited under a cloud of perjury.

Whatever the true facts, this innocent, honest woman does not deserve jail time, especially as she has only one functioning kidney, and is unlikely to leave jail alive - a scenario which I believe may well be the result desired by Judge Adams, DA Vieira, and whoever are the behind-the-scenes manipulators in this surreal case.

HANG YOUR HEAD IN SHAME CITY OF FAIRFIELD-- IF SUSPECTS IN CHILD KIDNAP CASES ARE PAID OFF, SOLANO COUNTY IS  A SAFE HAVEN FOR PEDOPHILES! On May 2, 1997, the City of Fairfield, (located in Solano County) paid Timothy Bindner $90,000 to settle his lawsuit against the Fairfield police for having executed a search warrant at his Oakland home looking for evidence pertaining to Nikki Campbell and Amber Swartz Garcia.  Bindner's status was classified as a suspect in these and several other cases at the time of the payment.  Attorneys for Binder were Gary Lepper and Matthew Harrington, his partner, who also defended the Emeryville child molesters at the Emery Unified School District.  None of these molesters were prosecuted either and they are walking around free and some of them are teaching school children, and others are government officials and owners of corporations in Alameda County.
